Տավուշի մարզի ընդհանուր իրավասության դատարանի դատավոր Զոյա Զաքինյանը հունիսի 14–ին փաստաթուղթ կեղծելու մեջ մեղադրվող Նիկոլ Փաշինյանի ազգականի՝ Մամիկոն Հովհաննիսյանի գործով դատավճիռ է կայացրել։

Դատական տեղեկատվական համակարգից տեղեկացանք, որ Մամիկոն Հովհաննիսյանը մեղավոր է ճանաչվել  2019թ փետրվարի 19-ին իրավաբանական փաստ հաստատող՝ իրավունք վերապահող ակնհայտ կեղծ պաշտոնական փաստաթուղթ օգտագործելու համար և դատապարտվել  200.000 դրամ տուգանքի։

Մինչ գործով դատաքննություն սկսելը Մամիկոն Հովհաննիսյանը հայտարարել է որ համաձայն է իրեն առաջադրված մեղադրանքի հետ և միջնորդել է գործը քննել արագացված դատական կարգով։

Հիշեցնենք, որ վարչապետի ազգականին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 325-րդ հոդվածի 1-ին մասով այն բանի համար, որ նա, 2019թ. փետրվարի 19-ին օգտագործել է իրավաբանական փաստ հաստատող` իրավունք վերապահող ակնհայտ կեղծ պաշտոնական փաստաթուղթ:

Մասնավորապես նա 2018թ. օգոստոսի 21-ին «Դիլիջան ազգային պարկ» ՊՈԱԿ–ի տնօրենի հրամանով  աշխատանքի է անցել նշված կազմակերպությունում և զբաղեցրել է մեխանիկի պաշտոնը: Նա, չունենալով բարձրագույն կրթություն, տնօրենի տեղակալի պաշտոնը զբաղեցնելու համար ձեռք է բերել և օգտագործել բարձրագույն կրթություն ունենալու հանգամանքը հավաստող կեղծ փաստաթուղթ` Հայկական գյուղատնտեսական ինստիտուտը 1993թ.-ին ավ նա նշանակվել է նույն հիմնարկի պահպանության բաժնի պետ-տնօրենի տեղակալի պաշտոնում:

Նշենք, որ ՔՕ 325-րդ հոդվածի 1-ին մասով արարքը պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից չորսհարյուրապատիկի չափով, կամ ազատազրկմամբ՝ առավելագույնը երկու տարի ժամկետով։ Այսպիսով դատարանը որոշում է կայացրել Հովհաննիսյանի նկատմամբ մեղմ պատիժ սահմանել՝ նրան տուգանելով 200.000 դրամով։

Հիշեցնենք, որ Նիկոլ Փաշինյանը ապրիլի 4-ին ֆեյսբուքյան գրառում էր արել` նշելով, որ իր ցուցումով իր ազգականի ենթադրյալ չարաշահման դեպքի առթիվ հարուցվել է քրեական գործ. «Կասկած չկա, որ գործը լիարժեք կքննվի եւ մեղավորները կենթարկվեն օրենքով նախատեսված պատասխանատվության: Սա նոր Հայաստան է, եւ վարչապետի որեւէ մերձավոր չի կարող վեր լինել օրենքից կամ լինել արտոնյալ», - նշել էր նա՝ չմանրամասնելով, թե ում մասին է խոսքը։
