«Երեխաների քաղաք» ծրագիրը հակասում է երեխայի լավագույն շահին. ՄԻՊ-ի դիրքորոշումը

ՀՀ մարդու իրավունքների պաշտպանն իր մտահոգությունն է հայտնում «Հայկական Կարիտաս» կազմակերպության «Երեխաների քաղաք» ծրագրի վերաբերյալ ՀՀ կառավարության կողմից տրված դրական եզրակացության վերաբերյալ: Ինչպես հայտնեցին ՀՀ Մարդու իրավունքների պաշտպանի աշխատակազմի հանրային կապերի բաժնից, Պաշտպանի դիրքորոշմամբ ծրագիրը հակասում է երեխայի լավագույն շահին և Հայաստանի ստանձնած միջազգային պարտավորություններին:

Ծրագրի իրականացումն այս տարբերակով կնպաստի հաշմանդամություն ունեցող  և սոցիալապես անապահով երեխաների նկատմամբ կարծրատիպերի և խարանի խորացմանը։

Մասնավորապես, Պաշտպանն արձանագրում է հետևյալ հիմնարար նկատառումները՝

·         Սոցիալական տարբեր խմբերին պատկանող և հաշմանդամություն ունեցող երեխաներին իրենց համայնքներից տեղափոխելը և նրանց համար հատուկ կառուցվող բնակավայրում տեղավորելը հակասում է համայնքում ապրելու հավասար իրավունքին («Հաշմանդամություն ունեցող անձանց իրավունքների մասին» ՄԱԿ-ի կոնվենցիա),

·         Քաղաքի կառուցումը հակասում է նաև ՄԱԿ-ի մանկական հիմնադրամի «Երեխայակենտրոն քաղաք» ծրագրի սկզբունքներին: «Երեխայակենտրոն քաղաք» ստեղծելը չի նախատեսում մեկուսացած բնակավայրերի կառուցում: Ավելի քան 35 երկրների փորձի ուսումնասիրությունը ցույց է տալիս, որ բոլոր երկրներն էլ կարևորում են համայնքի ողջ բնակչության ներգրավվածությունը երեխայակենտրոն քաղաքների ստեղծման գործում, այլ ոչ թե դրա կառուցումը երեխաներին հասարակությունից մեկուսացնելու կամ առանձնացնելու սկզբունքով,

·         Ծրագրով նախատեսված միայն կրթության և ինքնազարգացման սահմանափակ հնարավորությունների պայմաններում ապրող երեխաների և հաշմանդամություն ունեցող երեխաների մասնակցությամբ կրթությունը խնդրահարույց է երեխաների ներառականության տեսանկյունից:

Մարդու իրավունքների պաշտպանի դիտարկմամբ՝ Հայաստանի Հանրապետությունը պետք է առաջնորդվի հաշմանդամություն ունեցող անձանց իրավունքների պաշտպանության բարձր առաքելությամբ: Պետությունը պետք է աջակցի, պաշտպանի և ապահովի, որպեսզի հաշմանդամություն ունեցող անձինք լիարժեքորեն և հավասարապես իրացնեն իրենց իրավունքները, ինչպես նաև ապահովվի հարգանքը նրանց արժանապատվության նկատմամբ:

Պաշտպանը դիրքորոշումը ներկայացրել է ՀՀ կառավարություն՝ առաջարկելով լրամշակել ծրագիրը՝ առաջնորդվելով երեխայի լավագույն շահով:
