ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննության ընթացքում տվյալներ են ձեռք բերվել, որ Երևան քաղաքի գլխավոր հատակագծով հասարակական նշանակության կանաչ տարածքների գոտում ներառված` Երևան քաղաքի Ազատության պողոտա 2/5 հասցեում գտնվող 10.000քմ հողատարածքը Երևանի քաղաքապետի 12.03.2008թ. որոշմամբ, «Հաղթանակ» զբոսայգու զբաղեցրած տարածքի վերաճշտման պատճառաբանությամբ թողարկված նոր գլխավոր հատակագծով, անհիմն և ապօրինի կերպով դուրս է թողնվել հիշյալ զբոսայգու տարածքից;

Այնուհետև Երևանի քաղաքապետի կողմից ծառայության շահերին հակառակ կայացված մեկ այլ՝ 08.04.2008թ. որոշմամբ օրենսդրությամբ նախատեսված սահմանափակումների ցանկում ընդգրկված և օտարման ոչ ենթակա վերը նշված հողատարածքը կադաստրային արժեքով` 164.760.000 ՀՀ դրամով /այսինքն` 1քմ-ն ընդամենը 16.476 ՀՀ դրամով/, ուղղակի վաճառքի միջոցով օտարվել է «Գոլդեն Փելիս» Հյուրանոց» ՍՊ ընկերությանը: 29.05.2015թ.-ին հիշյալ ընկերությունն այդ հողատարածքի գրավադրմամբ ՀՀ-ում գործող առևտրային բանկերից մեկից ստացել է 2.800.000 ԱՄՆ դոլար վարկ:

Հետագայում ընկերության և բանկի միջև կնքված մի շարք համաձայնագրերով վարկային պայմանագրում կատարված փոփոխություններով համագործակցության գումարը հետզհետե ավելացել է՝ հասնելով մինչև 12 միլիարդ ՀՀ դրամի, ինչը շուրջ 70 անգամ գերազանցում է տվյալ հողատարածքի ձեռք բերման արժեքը:

Նկատի ունենալով, որ նախաքննությամբ ձեռք բերված փաստական տվյալներում առերևույթ առկա են Երևանի նախկին քաղաքապետի կողմից պաշտոնեական դիրքը չարաշահելու ենթադրյալ հանցագործության հատկանիշներ, որպիսի արարքով էական վնաս է պատճառվել Երևան համայնքի օրինական շահերին, 30.08.2019թ.-ին որոշում է կայացվել վերը նշված դեպքի առթիվ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով քրեական գործ հարուցելու մասին:

Նախաքննությունը շարունակվում է: Ձեռնարկվում են անհրաժեշտ քննչական և այլ դատավարական գործողություններ՝ դեպքի հանգամանքներն ամբողջ ծավալով բացահայտելու և մեղավորներին ի հայտ բերելու ուղղությամբ:

 

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
