«Վարչարարության հիմունքների և վարչական վարույթի մասին» ՀՀ օրենքում փոփոխություններ և լրացումներ կատարելու մասին օրենքի նախագծի քննարկումների ժամանակ ԱԺ «Օրինաց երկիր» խմբակցության ղեկավար Հեղինե Բիշարյանն ասաց.
Այն, ինչ մենք ստեղծեցինք մեր ժողովրդի գլխին, դրա հետ համեմատած՝ մի քայլ առաջ է, բայց իրականում պետք չէ ոգևորվել այն ամենից, ինչ այսօր ներկայացված է, որովհետև մենք սահմանադրական խախտումով ենք առաջ գնում: Ի՞նչ է նշանակում, որ եթե մի քաղաքացին 200 հազարի տուգանք ունի, իրավունք չունի դատական կարգով վիճարկելու: Առավել ևս, որ կան բազմաթիվ դեպքեր, երբ մեքենան մեկ այլ անձի անունով է, ինքը գրանցված է մեկ վայրում, սակայն բնակվում է մեկ այլ վայրում: Մինչև տվյալները հասնում են տվյալ մարդուն, կարող է ամիսներ տևել: Բացի դրանից՝ ինչի՞ց ելնելով է որոշվել այդ 200 հազարը»,- ասում է պատգամավորը և հարց ուղղում,- «Դուք չե՞ք կարծում, որ համաներման գաղափարը պետք է կիրառել, որպեսզի մենք կարողանանք այդ ընտանիքներին բեռից հանել»:
Արդարադատության փոխնախարար Արսեն Մկրտչյանը, պատասխանելով Հեղինե Բիշարյանին, ասաց, որ առաջարկվում է համաներման այդ մեխանիզմը: Իրենք անցումային դրույթներում գրում են բոլոր այդ իրավախախտումները, որոնցով ավելացված տուգանքները 6 ամսվա ընթացքում վճարելու դեպքում մարդիկ ազատվում են տույժերից և տուգանքներից: Մայր օրենքը հնարավորություն է տալիս 6 ամիս մայր գումարը վճարել և ազատվել ամբողջ ծավալից:
«Բացի դրանից՝ մենք ևս մեկ քայլ ենք անում՝ մինչև 2012 թվականի հունվարի 1-ը կատարված վարչական իրավախախտումները համարում ենք չկատարված», -հավելեց Արսեն Մկրտչյանը:
