ՄԻԵԴ-ը Մեծ պալատ է ձեւավորել՝ Ռոբերտ Քոչարյանի գործով ՍԴ-ին խորհրդատվական կարծիք տալու համար

Մարդու իրավունքների եվրոպական դատարանն (ՄԻԵԴ) ընդունել է Սահմանադրական դատարանի դիմումը՝ Երեւան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի եւ Ռոբերտ Քոչարյանի դիմումների հիման վրա Սահմանադրական դատարանի կողմից քննության ընդունված գործերով խորհրդատվական կարծիք ստանալու համար։

ՄԻԵԴ-ի պաշտոնական տեղեկատվության համաձայն խորհրդատվական կարծիքի դիմումն ստացել են 2019 թվականի սեպտեմբերի 2-ին, իսկ հոկտեմբերի 2-ին Մեծ պալատի հանձնաժողովի կողմից այն վարույթ է ընդունվել:

Ստեղծվել է 17 դատավորից բաղկացած Մեծ պալատ: Մեծ պալատի նախագահը սահմանել է նաեւ ժամկետները՝ ներպետական դատավարության կողմերից կամ այլ շահագրգիռ կողմերից, այդ թվում ՀՀ Կառավարության, ինչպես նաեւ մարդու իրավունքների հանձնակատարի, գրավոր փաստարկների ներկայացման համար։

Նշվում է, որ ՀՀ Սահմանադրական դատարանի դիմումով պահանջվող խորհրդակցական կարծիքը վերաբերում է ՀՀ քրեական օրենսգրքի 300.1 հոդվածի սահմանադրականությանը։

Մեծ պալատի նախագահը հրավիրել է Սահմանադրական դատարանի դատավարության կողմերին, մասնավորապես Ազգային ժողովին եւ ՀՀ նախկին նախագահ Ռոբերտ Քոչարյանին, գրավոր դիտարկումներ ներկայացնել մինչեւ 2019 թվականի նոյեմբերի 19-ը:

Հիշեցնենք, որ հուլիսի 18-ին Հայաստանի Հանրապետության Սահմանադրական դատարանն ընդունել է աշխատակարգային որոշումներ՝ «Երևան քաղաքի ընդհանուր իրավասության դատարանի և Ռոբերտ Քոչարյանի դիմումների հիման վրա՝ Հայաստանի Հանրապետության քրեական օրենսգրքի 300.1-րդ հոդվածի՝ Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ» գործերով խորհրդատվական կարծիք ստանալու նպատակով Մարդու իրավունքների եվրոպական դատարանին և Վենետիկյան հանձնաժողովին դիմելու և այդ կապակցությամբ հիշյալ գործերի վարույթները՝ մինչև պատասխանները ստանալը, «Սահմանադրական դատարանի մասին» սահմանադրական օրենքի 56-րդ հոդվածի առաջին մասի 5-րդ կետի հիմքով կասեցնելու վերաբերյալ:
