Դատարանը մերժեց Վանեցյանի վերաբերյալ քրգործ չհարուցելու որոշման դեմ Դանիել Իոաննիսյանի բողոքը

Երևանի ընդհանուր իրավասության դատարանը, դատավոր Կարեն Ֆարխոյանի նախագահությամբ, այսօր` հոկտեմբերի 17-ի  մերժեց ԱԱԾ նախկին տնօրեն Արթուր Վանեցյանի կողմից պաշտոնեական դիրքը չարաշահելու փաստի  առթիվ քրեական գործ չհարուցելու քննիչի որոշման դեմ Դանիել Իոաննիսյանի բողոքը։ Հիշեցնենք, որ այս տարվա մայիսին Հայաստանի Հատուկ քննչական ծառայությունը մերժել էր Ազգային անվտանգության ծառայության վերաբերյալ դիմումի հիման վրա քրեական գործ հարուցել` հանցադեպի բացակայության հիմքով։ Ավելի վաղ իրավապաշտպան Արթուր Սաքունցը և «Իրազեկ քաղաքացիների միավորման» ծրագրերի համակարգող Դանիել Իոաննիսյանը Հատուկ քննչական ծառայություն հանցագործության մասին հաղորդում էին ներկայացրել` պնդելով, որ Ազգային անվտանգության ծառայությունում տեղի է ունեցել պաշտոնեական դիրքի չարաշահում։

Բանն այն է, որ Ազգային անվտանգության ծառայությունը նամակ էր ուղարկել «Քաղաքացու որոշում» (ՔՈ) կուսակցության անդամ Գարեգին Միսկարյանին՝ պահանջելով հերքել իր ֆեյսբուքյան գրառումը ԱԱԾ տնօրեն Արթուր Վանեցյանի՝ ծաղիկների բիզնես ունենալու և վառելանյութ ներկրելու մասին:

Գրառման մեջ Միսկարյանը նշել էր․

«Էն, որ Վանեցյանի ընտանիքը ծաղիկի բիզնես ունի ու դրա ջերմոցների անվան տակ ժամանակին պարսկական դիզելը վառարանի վառելանյութի անվան տակ մաքսազերծում ու վաճառում էին` լսել էինք, բայց որ Նոր Հայաստանում էլ վառելանյութի ներկրմամբ էին զբաղվում, դա նորություն էր»։  Սաքունցն ու Իոաննիսյանն էլ պնդել էին, որ պաշտոնական անձինք պաշտոնեական դիրքը օգտագործել են, որպեսզի պաշտպանեն ԱԱԾ-ի տնօրեն Արթուր Վանեցյանի այն շահերը, որոնք ենթակա են պաշտպանության իրավաքաղաքացիական հարաբերությունների սահմաններում։
