Պղտոր ջրում ձուկ բռնողները կամ ինչու է թիրախավորվում ՊԵԿ-ը

Վերջին օրերին բավական ակտիվ քննարկվում է ավտամաքսատունը Երևանից Գյումրի տեղափոխելու, աջ ղեկով ավտոմեքենաների շահագործումը արգելելու, դրանք ՀՀ-ում ձախ դարձնելու, ինչպես նաև երկու և ավելի մեքենա նույն անձի անունով ներկրելու պարագայում հարկերի կիրառման և այլ աղմկահարույց օրակարգեր։
 
Ուշագրավ է, որ այդ բոլոր հարցերով քննադատությունների վեկտորն ուղղվում է դեպի Պետական եկամուտների կոմիտե, ընդ որում՝ անզեն աչքով էլ տեսանելի է, որ հաճախ դա արվում է նպատակային և ուղղորդված, իսկ մեծամասամբ ձևավորվում է արհեստական օրակարգ, որովհետև դժվար թե պատվիրատուները չիմանան որոշում կայացնողների և դրանց կիրառողների տարբերությունը:
 
Իրականում հիշյալ հարցերի հասցեատերը ՊԵԿ-ը չէ, վերջինս կառավարության կողմից ընդունված պետական քաղաքականության իրականացնողն է:
 
Փաստացի ավտոմաքսատունը Գյումրի տեղափոխելու գաղափարը և որոշումը վարչապետ Փաշինյանինն են, մնացածը կատարողն են, այդ թվում՝ նաև ՊԵԿ-ը, իսկ տվյալ դեպքում ՊԵԿ-ին մեղադրելն ուղղակի անմտություն է։
 
Նշենք, որ բեռնարկղերով բերված ավտոմեքենաների տարհանումը սկսվել է բոլորովին վերջերս (երկուշաբթի), տարհանումն իրականացնում է օրինական մրցույթով հաղթած ընկերությունը։ Այստեղ իրականում, հնարավոր է, որ առկա լինի որոշակի դանդաղկոտություն՝ անփորձության հետ կապված, բայց, ըստ էության, սա ընդամենն աշխատանքի մեկնարկն է դեռ, ու հնարավոր են ընթացիկ խնդիրներ, որոնք աստիճանաբար կկարգավորվեն, ինչի մասին, ի դեպ, քանիսց հայտարարել է ՊԵԿ-ը:
 
Մյուս բոլոր առումներով ակնհայտ է, որ Գյումրու նոր մաքսատունը, կազմավորվելով ռեկորդային կարճ ժամանակահատվածում, կրկնակի ներուժով ու որակական հատկանիշներով գերազանցում է Նորագավիթի մաքսատանը. նման տեսակետ են հայտնում, ի դեպ, ոլորտի բոլոր մասնագետները,,,
 
Հաջորդ խնդիրը, ինչի արդյունքում ՊԵԿ-ը թիրախավորվում է, հետևյալն է․ ֆինանսների նախարարության առաջարկությամբ, կառավարության ներկայացմամբ 2018-ի հուլիսին ԱԺ-ն օրենք է ընդունել, համաձայն որի՝ երկու և ավել ավտոմեքենա նույն ներկրողը պետք է հարկ վճարի՝ չեզոքացնելով նվիրատվության արտոնությունը։ Ըստ էության՝ ՊԵԿ-ն այդ օրենքի փաստացի կիրառողն է, ու ավտոմեքենաների ներկրման բիզնեսով զբաղվողներին էլ բնականաբար այս կառույցն է ծանուցումներ ուղարկում իրենց տուգանքների մասին։ ՊԵԿ-ը չի կարող հիշյալ կարգավորումները չիրականացնել, չի կարող ասել՝ ես օրենքը չեմ կիրառում.
 
Ցանկացած կազմակերպություն՝ պետական, թե մասնավոր, ուղղակի պարտավոր է ենթարկվել օրենքներին։ Իսկ եթե խնդիրներ կան օրենքի հետ, ապա հասցեատերը այլ տեղ է՝ կառավարությունն ու Ազգային ժողովը: Եվ տարօրինակ է, որ, ասենք, սույն առաջարկությունը ներկայացրած ֆինանսների նախարարությունը ոչ մի պատասխանատվություն չի կրում, իսկ նույն ՊԵԿ-ը ստիպված է և օրենքը կիրառել, և թուք ու մուրը ուտել...
 
Անդրադառնանք ևս մի խնդրահարույց հարցի. խոսքը աջ ղեկով մեքենաների ճակատագրի մասին է, որն ամբողջությամբ տրանսպորտի ոլորտի հարց է և իր հերթին դարձյալ կարգավորվում է համապատասծխան օրենսդրությամբ ու կառավարության նորմատիվ ակտերով․ սահմանված է, որ չեն կարող ներկրել աջ ղեկ ունեցող մեքենաներ, և ավտոներկրողների՝ այսպես կոչված «դալալների» կողմից ՊԵԿ-ին ուղղված մեղադրանքը, թե՝ «ՊԵԿ-ն իրենց թույլ չի թույլ տալիս, փողը գնում է ադրբեջանցիների գրպանը»՝ դասական տկարամտություն է կամ պարզունակ մանիպուլյացիա։ Նունիսկամենալավագույն ցանկության դեպքում ՊԵԿ-ը չի կարող նման բան անել, որովհետև ՊԵԿ-ը օրենքի կիրառողն է, ոչ թե մեկնաբանողը կամ ընդունողը...
 
Մի խոսքով, ներկրողների կողմից ՊԵԿ-ին ուղղված ոչ մի մեղադրանք իրավական ու բարոյական հիմք չունեն, դրանք ուղղակի բեմականացնում են, որի արանքում ոմանք պղտոր ջրում ձուկ են որսում...
