ՀՀ Ազգային ժողովն առաջին ընթերցմամբ ընդունեց «Ծխախոտային արտադրատեսակների և դրանց փոխարինիչների օգտագործման հետևանքով առողջությանը հասցվող վնասի նվազեցման և կանխարգելման մասին» օրենքի նախագիծն ու կից ներկայացված օրենքների նախագծերի փաթեթը:

Օրենքի նախագիծը դեկտեմբերի 10-ի խորհրդարանի նիստում ընդունվեց 83 կողմ և 15 դեմ ձայներով:

Օրենքի նախագծով՝ ծխախոտի օգտագործման արգելք է սահմանվում փակ տարածքներում։ Սահմանափակումներ կլինեն հանրային տրանսպորտում, մանկական խաղահրապարակներում, առողջապահական, կրթական, մշակութային հաստատություններում։ Որոշակի կարգավորումներ են նախատեսվում նաև ծխախոտի վաճառքի և ծխախոտային արտադրանքի առաջխաղացման և գովազդի սահմանափակման ուղղությամբ։

Օրենքների նախագծերի փաթեթում ընդգրկված «Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագծով նախատեսվում է, որ, մասնավորապես, մասնավոր ավտոմոբիլային տրանսպորտային միջոցի վարորդի կողմից տրանսպորտային միջոցի ընթացքի ժամանակ ծխախոտային արտադրատեսակ կամ ծխախոտային արտադրատեսակների փոխարինիչներ օգտագործելն առաջացնում է տուգանքի նշանակում՝ սահմանված նվազագույն աշխատավարձի տասնապատիկի չափով:

Ծխախոտային արտադրատեսակի կամ ծխախոտային արտադրատեսակի փոխարինիչների օգտագործման կամ դրանց օգտագործման  սահմանափակման արգելքը խախտելը, բացառությամբ սույն օրենսգրքի 135.1, 135.2 հոդվածների, առաջացնում է տուգանքի նշանակում պաշտոնատար անձի նկատմամբ՝ սահմանված նվազագույն աշխատավարձի հարյուրհիսնապատիկից երկուհարյուրապատիկի չափով, իսկ ֆիզիկական անձի նկատմամբ՝ հիսունապատիկի չափով: Նույն արարքն այն պաշտոնատար անձի կողմից կատարելը, որը նշված խախտման համար վարչական տույժի է ենթարկվել երեք ամսվա ընթացքում, առաջացնում է տուգանքի նշանակում՝ սահմանված վարչական տույժի կրկնակի չափով:

Օրենքով նախատեսված դեպքերում հաստատությունների կամ հիմնարկների, կամ վայրերի, կամ տարածքների տեսանելի հատվածներում ծխախոտային արտադրատեսակների կամ ծխախոտային արտադրատեսակների փոխարինիչների օգտագործման  արգելքի մասին տեղեկատվություն պարունակող ցուցանակների բացակայությունն առաջացնում է տուգանքի նշանակում պաշտոնատար անձանց նկատմամբ՝ սահմանված նվազագույն աշխատավարձի հարյուրապատիկի չափով:
