«Փաստ» օրաթերթը գրում է

Երեկ ԱԺ «Իմ քայլը» խմբակցության պատգամավորներից մեկը ուշագրավ միտք է արտահայտել՝ զուգահեռ ՍԴ նախագահ Հրայր Թովմասյանին մեղադրելով «անգրագիտության» մեջ: Նա մասնավորաբար ասել է, թե Թովմասյանը չի հասկանում, «որ ՍԴ նախագահը դատական իշխանության ներկայացուցիչը չէ, դատական իշխանությունը ներկայացնում է դատական խորհուրդը»: 

Անշուշտ, կարծիք հայտնել որևէ մեկին արգելված չէ, սակայն երևի թե ճիշտ կլիներ, եթե որևէ թեմայի մասին կարծիք հայտնողը գոնե մի անգամ այդ թեմային առնչվող ինչ-որ բան կարդար, տվյալ դեպքում՝ գոնե ՀՀ Սահմանադրությունը, ուր «Դատարանները» բաժնում սևով սպիտակի վրա գրված է. 

«Հայաստանի Հանրապետությունում գործում են Սահմանադրական դատարանը, Վճռաբեկ դատարանը, վերաքննիչ դատարանները, առաջին ատյանի ընդհանուր իրավասության դատարանները, ինչպես նաեւ վարչական դատարանը»: Ինչ վերաբերում է ԲԴԽ-ին, ապա, որքան էլ ոմանց համար տարօրինակ հնչի, այս կառույցի մասին էլ հոդված կա Սահմանադրության մեջ. 

«Բարձրագույն դատական խորհուրդն անկախ պետական մարմին է, որը երաշխավորում է դատարանների եւ դատավորների անկախությունը»: Սակայն նման «լ յապերը» (անկախ հետագա «սրբագրումներից») պատահական չեն ոչ միայն ընդհանրապես, այլև մասնավորաբար այս դեպքում, քանզի «ամենավերևից» հրահանգը հստակ է՝ ամեն գնով սևացնել ՍԴ նախագահին ու ՍԴ դատավորներին: 

Իսկ հանձնարարությունը կատարելու ճանապարհին (հատկապես հրատապ ռեժիմով) «բոլոր միջոցներն արդարացված են»: Երեկ առավոտ կանուխ վարչապետն ինքն էր կատարել գրառում, որը ոչ միայն իրավական համայնքի, այլև ընդհանրապես հանրության տարակուսանքն էր առաջացրել:

 «Հրայր Թովմասյանը չի կարող լինել ՍԴ նախագահ եւ որևէ կապ ունենալ ՍԴ-ի հետ»,-գրել էր Փաշինյանը: Այս գրառումն արդեն տարբեր փորձագետների կողմից որակվել է որպես վարչապետի ուղղակի հրահանգ իր թիմին ու իրավապահներին, իսկ Հրայր Թովմասյանի փաստաբանը նշել է. 

«Սահմանադրական սկզբունքների խախտման, հիմնարար իրավունքների կոպիտ և ցինիկ ոտնահարման մասին խոսելն այլևս ավելորդ է։ Գործ ունենք սահմանադրական կարգի տապալման և Սահմանադրական դատարանի յուրացման առերևույթ հանցակազմի հետ»:
