Պետական սեփականության գույքը վաճառվել է 3.5 անգամ ցածր գնով, հարուցվել է քրեական գործ: Այս մասին NEWS.am-ին հայտնում են ՀՀ Գլխավոր Դատախազությունից:

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչության կողմից ուսումնասիրվել են պետական սեփականություն հանդիսացած՝ Երևան քաղաքի Շենգավիթ համայնքի Բագրատունյաց փողոցի  89 հասցեում գտնվող 1080 քմ մակերեսով գույքի օտարման գործընթացի վերաբերյալ ՀՀ պետական գույքի կառավարման կոմիտեից ստացված փաստաթղթերը։

Ուսումնասիրությամբ պարզվել է, որ ՀՀ ԿԱ պետական գույքի կառավարման վարչության պաշտոնատար անձինք, խախտելով «Անշարժ գույքի գնահատման գործունեության մասին» ՀՀ օրենքի դրույթները, առանց պայմանագիր կնքելու, 2016թ. ՍՊԸ-ին առաջարկել են իրականացնել գույքի գնահատում։ Այդ  առաջարկի հիման վրա ՍՊԸ-ն 2017թ.-ին նշված գույքը նվազեցված հողամասի կադաստրային արժեքով գնահատել է 28.4մլն ՀՀ դրամ:

ՀՀ կառավարությանն առընթեր պետական գույքի կառավարման վարչության պետի 2017թ. հոկտեմբերի 3-ի հրամանով նախաձեռնվել է մրցույթով նշված գույքի օտարումը՝ նույն հրամանով նախատեսելով, որ առաջին մրցույթի ժամանակ գույքի չվաճառվելու դեպքում յուրաքանչյուր հերթական մրցույթի ժամանակ գույքի վաճառքի գինը նվազեցվում էլ վերջին մրցույթի գնի 20 տոկոսի չափով: Արդյունքում գույքը քաղաքացուն վաճառվել է 2-րդ մրցույթով՝ ըստ 2018թ. փետրվարին կնքված գույքի օտարման և գրավի պայմանագրի՝ 18.5մլն ՀՀ դրամով:

Հետագայում ՀՀ պետական գույքի կառավարման կոմիտեի «Պետական գույքի գույքագրման և գնահատման գործակալություն» ՊՈԱԿ-ի կողմից կատարվել է վերը նշված անշարժ գույքի շուկայական արժեքի վերլուծություն: Արդյունքում պարզվել է, որ օտարված գույքի շուկայական արժեքը 2017թ. հունիս ամսվա դրությամբ, այսինքն ՍՊԸ-ի կողմից գնահատման պահի դրությամբ, կարող էր կազմել ոչ թե 28.4մլն ՀՀ դրամ, այլ՝ 65մլն ՀՀ դրամ կամ շուրջ 2 անգամ ավել սկզբնական գնահատված արժեքից:

Այս դեպքում, հաշվի առնելով, որ արժեքը գերազանցում է 50մլն դրամը, ըստ ՀՀ կառավարության 2003թ. հունիսի 13-ի թիվ 882-Ն որոշման՝ նշված անշարժ գույքը պետք է օտարվեր ոչ թե ՀՀ կառավարությանն առընթեր պետական գույքի կառավարման վարչության պետի հրամանի, այլ ՀՀ կառավարության որոշման հիման վրա։

Այսինքն ուսումնասիրությամբ արձանագրված տվյալները վկայում են, որ  թեև Երևան քաղաքի Բագրատունյաց փողոցի 89 հասցեում գտնվող 1080 քմ մակերեսով 65մլն ՀՀ դրամ իրական արժեքով գույքը ենթակա էր մասնավորեցման բացառապես ՀՀ կառավարության որոշմամբ, սակայն ՀՀ ԿԱ պետական գույքի կառավարման վարչության պատասխանատու պաշտոնատար անձինք, պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով առանց պայմանագիր կնքելու, 2016թ․ՍՊԸ-ի միջոցով իրականացրել են վերոնշյալ գույքի գնահատման աշխատանքներ, որի արդյունքում գույքը գնահատել է ավելի քան կրկնակի պակաս արժեքով և օտարվել 3.5 անգամ ցածր գնով:

Նկատի ունենալով, որ ուսումնասիրության շրջանակներում ի հայտ են եկել պաշտոնատար անձի կողմից պաշտոնեական լիազորությունները ծանր հետևանքների առաջացմամբ չարաշահելու առերևույթ հատկանիշներ պարունակող տվյալներ՝ ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասի հատկանիշներով հարուցվել է քրեական գործ։ Նախաքննություն կատարելու հանձնարարությամբ վերջինս ուղարկել ՀՀ քննչական կոմիտե:
