ՀՀ փաստաբանների պալատի նախագահ Արա Զոհրաբյանը պարետից խնդրում է պարզաբանել

ՀՀ փաստաբանների պալատի նախագահ Արա Զոհրաբյանը այսօր՝ ապրիլի 1-ին, դիմել է պարետ Տիգրան Ավինյանին խնդրանքով, տեղեկացնում են ՓՊ-ից: 

Խնդիրն այն է, որ պարետի 31.03.2020թ. № 27 որոշման № 1 հավելվածով սահմանվել է Հայաստանի Հանրապետության ողջ տարածքում անձանց ազատ տեղաշարժի իրավունքի նկատմամբ ժամանակավոր սահմանափակումները, իսկ № 2 հավելվածով՝ Հայաստանի Հանրապետության ողջ տարածքում տնտեսական գործունեության տեսակների նկատմամբ ժամանակավոր սահմանափակումները:

Նշված որոշման № 2 հավելվածի աղյուսակ 1-ում (M) Մասնագիտական, գիտական եւ տեխնիկական գործունեություն բաժնում՝ 69.10 կոդի դիմաց «Թույլատրված» սյունակում նշվել է «Բացառությամբ փաստաբանական գործունեության մասով», իսկ «Արգելված» սյունակում՝ «Մեծամասամբ արգելվում է: Հնարավոր է բացառապես առցանց կամ հեռավար եղանակով» բառերը:

Պարզաբանել՝

Ա.

1. Արդյո՞ք փաստաբանական գործունեությունը Պարետի որոշմամբ սահմանափակվել կամ արգելվել է:

2. Եթե սահմանափակվել է, ապա՝ արդյո՞ք փաստաբանական գործունեությունը թույլատրվել է միայն առցանց կամ հեռավար կարգով. եթե այո, ապա ինչպե՞ս կարող է փաստաբանը մեղադրյալի հարցաքննությանը, քննչական այլ գործողություններին, կամ կալանավորման հարցը որոշող դատական նիստերին մասնակցել առցանց կամ հեռավար կարգով[1]:

Բ.  Փոփոխություն կատարել Պարետի 31.03.2020թ. № 27 որոշման № 2 հավելվածի Աղյուսակ 1-ում՝ (M) Մասնագիտական, գիտական եւ տեխնիկական գործունեություն բաժնում՝ 69.10 կոդի դիմաց՝

1. «Թույլատրված» սյունակում նշված «Բացառությամբ փաստաբանական գործունեության մասով» բառերը փոխարինել «Բացառապես փաստաբանական գործունեության մասով» բառերով.

2. «Արգելված» սյունակում՝ «Մեծամասամբ արգելվում է: Հնարավոր է բացառապես առցանց կամ հեռավար եղանակով» բառերից հետո լրացնել «Փաստաբանական գործունեությունը հնարավոր է իրականացնել ամբողջ ծավալով՝ Պարետի 31.03.2020թ. № 27 որոշման 3-րդ կետի պահպանման պայմանով»: Գ. Փոփոխություն կատարել Պարետի 31.03.2020թ. № 27 որոշման № 1 հավելվածի 7-րդ կետում՝

1) «5-րդ կետի» բառերը փոխարինել «6-րդ կետի» բառերով.

2) 3-րդ ենթակետում՝ «նույն ընկերության» բառերը փոխարինել «նույն գործատուի» բառերով:
