Մարդու իրավունքների եվրոպական դատարանում Սահմանադրական դատարանի նախագահի և դատավորների դիմումի վերաբերյալ

Երեկ երեկոյան ակտիվորեն ապատեղեկատվություն էր տարածվում այն մասին, թե իբր Մարդու իրավունքների եվրոպական դատարանը մերժել է Սահմանադրական դատարանի նախագահի և դատավորների դիմումն ընդդեմ Հայաստանի։

Հանրությանը տեղեկացնում ենք, որ Սահմանադրական դատարանի նախագահի և դատավորների գործը ներկայումս գտնվում է քննության փուլում։ Ավելին, Եվրոպական դատարանը, հաշվի առնելով խախտումների բնույթը և բարձրացված հարցերի կարևորությունը, հանձնառել է գործի անհապաղ քննություն։ Սույն թվականի հունիսի 26-ին ներկայացված տեղեկատվության հիման վրա արդեն իսկ հուլիսի 2-ին Կառավարությանն ուղղվել են մի շարք հարցեր։ Դատարանը, սահմանված ընթացակարգերին համապատասխան, շարունակում է կողմերին տրամադրել դիրքորոշումներ ներկայացնելու ժամկետներ։ Այդ նպատակով Եվրոպական դատարանն արդեն իսկ սահմանել է նոր ժամկետ՝ սույն թվականի օգոստոսի 28-ը, ինչը հավելյալ վկայում է գործի կարևորության նկատմամբ առկա ուշադրության մասին։

Իրականությանը չեն համապատասխանում նաև այն պնդումները, թե իբր Եվրոպական դատարանը մերժել է Սահմանադրական փոփոխությունների գործընթացը կասեցնելու Դիմումատուների խնդրանքը։ Սույնով տեղեկացնում ենք, որ Եվրոպական դատարանի կողմից լուծվում են ոչ թե այս կամ այն երկրում ընթացող օրենսդրական զարգացումներին առնչվող, այլ անձի իրավունքի խախտումներին վերաբերող կոնկրետ հարցեր։ Ուստի Եվրոպական դատարանի առջև բարձրացվել էր Դիմումատուների իրավունքների շարունակական խախտումները կանխելուն, ինչպես նաև կայացվելիք վճռի կատարումն ապահովելուն ուղղված միջանկյալ միջոցի կիրառման հարցը։

Հայտնի է, որ միջանկյալ միջոցի հնարավոր կիրառումը գտնվում է Եվրոպական դատարանի՝ լայն հայեցողություն ենթադրող դատական քաղաքականության տիրույթում, որի շահառուները ոչ միայն դիմումատուներն են, այլ նաև Մարդու իրավունքների եվրոպական դատարանը, որն այդ կերպ կարող է երաշխավորել իր վճռի կատարումը։

Պատահական չէ, որ սույն թվականի հունվարի 31-ին դատական տարվա բացմանը նվիրված միջոցառմանը Եվրոպական դատարանում քննարկվել է հենց միջանկյալ միջոցների վերաբերյալ դատական քաղաքականության փոփոխության անհրաժեշտությունը՝ որպես «Մարդու իրավունքների էկոհամակարգի» ուժեղացման միջոց, ինչը Եվրոպական դատարանին հնարավորություն կտար իրավունքի խախտումը բացահայտելու վաղ փուլերում դիմակայել դատավորների անկախությանը սպառնացող կառուցվածքային փոփոխություններին։

Այդուհանդերձ, Եվրոպական ընտանիքում դատական իշխանության անկախության պաշտպանությունը նոր մակարդակի բարձրացնելու իրական հնարավորության պայմաններում, Եվրոպական դատարանը նախընտրել է բավարարվել իր՝ պետության պատասխանատվությունը ճանաչող, անձի խախտված իրավունքի հատուցում և վերականգնում ապահովող դերով՝ ինքնասահմանափելով իր կանխարգելիչ գործառույթի տիրույթը։
