Երեկ հայտնի դարձավ, որ կոռուպցիայի կանխարգելման հանձնաժողովը (ԿԿՀ) Գագիկ Ծառուկյանի գործունեության վերաբերյալ որոշում է կայացրել, «անհամատեղելիության պահանջի առերեւույթ խախտման» հիմքով վարույթ հարուցելու պահանջ ներկայացնել: Եթե ավելի պարզ ձևակերպենք, հանձնաժողովականները գտնում են, որ Գագիկ Ծառուկյանը միջամտել է սեփականության իրավունքով իրեն պատկանող ձեռնարկությունների կառավարմանը: Մինչ բուն թեմային անցնելը կցանկանայի մեջբերել Հանրային ծառայության մասին օրենքի 31-րդ հոդված.
«Հանրային պաշտոն զբաղեցնող անձինք և հանրային ծառայողները չեն կարող զբաղեցնել իրենց կարգավիճակով չպայմանավորված պաշտոն պետական կամ տեղական ինքնակառավարման այլ մարմիններում, որևէ պաշտոն` առևտրային կազմակերպություններում, զբաղվել ձեռնարկատիրական գործունեությամբ, կատարել վճարովի այլ աշխատանք, բացի գիտական, կրթական և ստեղծագործական աշխատանքից»:
Այսինքն օրենքը արգելում է հանրային ծառայողներին զբաղվել ձեռնարկատիրությամբ, բայց միևնույն ժամանակ օրենքը չի արգելում, որ սեփականատերը որոշի, թե ով է կառավարելու իր ձեռնարկությունները, ինչը միանգամայն ռացիոնալ է:
Չեմ կարծում, թե ԿԿՀ անդամները այս պարզ ու միանգամայն տրամաբանական ձևակերպումներն անելու կամ հասկանալու ունակություններ չունեն և հենց այստեղ էլ գալիս ենք եզրահանգման, որ ամեն ինչ արվել է հապճեպ, առանց իրավական խորքային գնահատականի ու ուսումնասիրության և միայն անճարությունից դրդված են «սարքել» այս գործը, ինչպես և Գ. Ծառուկյանի հետ կապված մնացած բոլոր դեպքերում է:
Այսինքն կուլմինացիան այս ամենի այն է, որ սա հերթական պատվերն է Գագիկ Ծառուկյանի դեմ՝ ամեն գնով մի բան բստրել, հորինել, որ ԲՀԿ ղեկավարի վերաբերյալ ինչ-որ պրոցեսներ ընթացքի մեջ լինեն՝ ոմանց քաղաքական ամբիցիաները բավարարելու նպատակով:
Ինչ է ստացվում, արդեն որերորդ դեպքն է, երբ ինչ-որ մեկի քաղաքական ամբիցիաների երեսից պետության կարևոր ինստիտուտներ ուղղակի հեղինակազրկվում են: Թե ուր է տանելու այս ամենը, ոզնուն էլ է պարզ, մնում է մի փոքր համբերություն և ակնհայտը բոլորի համար էլ տեսանելի կդառնա:
