«Փաստ» օրաթերթը գրում է

Ինչպես հայտնի է, նախօրեին տեղի ունեցավ Սահմանադրական բարեփոխումների հանձնաժողովի հերթական նիստը, որի ընթացքում առաջարկ էր ներկայացվել ՀՀ իրավական համակարգում նոր՝ Գերագույն դատարան ստեղծելու մասին։ Նախնական տարբերակով այդ նոր համակարգի ստեղծումը պետք է տեղի ունենա Սահմանադրական և Վճռաբեկ դատարանների միավորման արդյունքում։ Այս թեման իրավաբանական ողջ հանրության ուշադրության կենտրոնում էր և լայն քննարկման ու կոշտ քննադատության առիթ դարձավ։

Մասնագետները պնդում են, որ սա իշխանության կողմից «ոտքի վրա ընդունված» հերթական որոշումների շարքից է, քանի որ գրեթե ոչ մի ռիսկ հաշվարկված չէ, ավելին՝ այն իր մեջ բավական լուրջ ականներ է պարունակում, որոնք կարող են «պայթել» հիմնականում վճիռները բողոքարկելիս, բացի այդ, ունի նաև ակնհայտ քաղաքական ուղղվածություն։ Տիրապետող կարծիքներից էր նաև այն, որ մեր դատաիրավական համակարգը ընդհանուր առմամբ պատկանում է ռոմանոգերմանական դատական ճյուղին, իսկ Գերագույն դատարան ձևավորելով՝ մեզ պարտադրում են անգլոսաքսոնական դատական համակարգը։

Թերթի տեղեկություններով, այս գործընթացում, ինչպես և օրվա իշխանության «սահմանադրական» գրեթե բոլոր հարցերում, հիմնական ու առանցքային դերակատարությունը Վահե Գրիգորյանինն է, որն այս առիթով որոշ հանձնաժողովականների հետ ինտենսիվ հանդիպումների մեջ է։

Նախնական տարբերակի համաձայն՝ այս հարցը առաջիկա ամիսներին դրվելու է հանրային քննարկման։ Մենք տեղեկություն ունենք նաև, որ տվյալ հարցի վերաբերյալ ԱԺ առաջիկա նստաշրջանի ընթացքում տեղի են ունենալու խորհրդարանական լսումներ։

Միևնույն ժամանակ, կարծիքներ են հնչում, որ այս գործընթացն ընդամենն իմիտացիա է, ու այս նախաձեռնությունն ամբողջովին մնալու է թղթի վրա. այս կարծիքը հիմնված է այն հանգամանքի վրա, որ իշխանությունները շնչակտուր ՍԴ դատավորներ են «փոխում», իսկ Գերագույն դատարան կազմելու իրական ցանկության դեպքում գործընթացը կա՛մ տեղի չէր ունենա, կամ ուղղակի կձգձգվեր։ Մյուս կողմից՝ թերթի հետ զրույցում հայտնի իրավաբաններից մեկը տեսակետ է հայտնել, որ նշյալ հապշտապությունը պայմանավորված է առաջիկա մեկ տարվա ընթացքում իշխանության քիմքին հաճելի, բացառապես քաղաքական ենթատեքստ ունեցող հարցերը ՍԴ-ով լուծելու խնդրով, իսկ այդ պարագայում ՍԴ նոր դատավորների ժամանակավորությունը Փաշինյանին չի հետաքրքրում։

Այսինքն, առկա է երկու տարբերակ. կա՛մ իշխանությունները ՍԴ նոր դատավորներին պարզապես կօգտագործեն ժամանակավորապես, կա՛մ Գերագույն դատարան այդպես էլ չի ստեղծվի:
