Քրեական գործով մեղադրյալ Վահագն Աբգարյանին ՀՀ ԱՆ «Նուբարաշեն» քրեակատարողական հիմնարկում մարմնական վնասվածք պատճառելու դեպքի առթիվ նախապատրաստված նյութերը ՀՀ գլխավոր դատախազության միջոցով ՀՀ քրեական դատավարության օրենսգրքի 190-րդ հոդվածի 6-րդ մասով սահմանված կարգով ուղարկվել է ՀՀ հատուկ քննչական ծառայություն՝ հետագա ընթացքը լուծելու։

ՀՀ հատուկ քննչական ծառայության քննիչի 2020 թվականի մարտի 5-ի որոշմամբ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով հարուցվել է քրեական գործ:
Կատարված նախաքննության արդյունքում պարզվել է, որ ՀՀ ԱՆ «Նուբարաշեն» քրեակատարողական հիմնարկի օրվա հերթափոխում ընդգրկված ծառայողները, խախտելով «Քրեակատարողական ծառայության մասին» ՀՀ օրենքի 24-րդ հոդվածի 1-ին մասի 1-ին և 4-րդ կետերով, ինչպես նաև «Հայաստանի Հանրապետության արդարադատության նախարարության քրեակատարողական ծառայության՝ կալանավորվածներին պահելու վայրերի և ուղղիչ հիմնարկների ներքին կանոնակարգը հաստատելու մասին» ՀՀ կառավարության որոշմամբ սահմանված պահանջները, 2020 թվականի փետրվարի 24-ին չարաշահել են իրենց պաշտոնեական լիազորությունները, որն էական վնաս է պատճառել «Նուբարաշեն» ՔԿՀ կալանավորված անձ Վ. Աբգարյանի իրավունքներին և օրինական շահերին:

Մասնավորապես՝ 2020թ. փետրվարի 24-ի երեկոյան քրեակատարողական հիմնարկի համապատասխան ծառայողները Վ. Աբգարյանին հիմնարկի պետի մոտ ուղեկցելու պատրվակով դուրս են բերել իր խցից և ուղեկցել մեկ այլ խուց, որտեղ գտնվող դատապարտյալները վիճաբանել են նրա հետ և հարվածներ հասցրել վերջինիս մարմնի տարբեր մասերին՝ պատճառելով առողջությանը թեթև վնասի հատկանիշներ պարունակող, ինչպես նաև առողջությանը թեթև վնասի հատկանիշներ չպարունակող մարմնական վնասվածքներ:
2020 թվականի օգոստոսի 26-ին ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով նախատեսված հանցագործությունը կատարելու կասկածանքով ձերբակալվել են քրեակատարողական ծառայության երկու աշխատակից։

Պատշաճ դատախազական հսկողության պայմաններում իրականացվում է գործի հանգամանքների բազմակողմանի, լրիվ և օբյեկտիվ նախաքննություն՝ դեպքին այլ պաշտոնատար անձանց հնարավոր առնչությունը պարզելու նպատակով։
