Ռոբերտ Նազարյանը չի կալանավորվի

Հանրային ծառայությունները կարգավորող հանձնաժողովի նախկին նախագահ Ռոբերտ Նազարյանը չի կալանավորվի։ Այս մասին ԼՈՒՐԵՐ․com-ի հետ զրույցում հայտնեց պաշտպան Գագիկ Խաչիկյանը։ Նա նշեց, որ Վերաքննիչ քրեական դատարանը՝ դատավոր Ռուբիկ Մխիթարյանի նախագահությամբ, մերժել է Ռոբերտ Նազարյանի նկատմամբ որպես խափանման միջոց կալանավորումն ընտրելու քննիչի միջնորդությունը մերժելու որոշման դեմ դատախազի բողոքը՝ անփոփոխ թողնելով Երևանի ընդհանուր իրավասության դատարանի որոշումը։ 

«Իհարկե, արդյունքները ընդունելի են։ Սակայն մենք բողոք էինք ներկայացրել, որ Ռոբերտ Նազարյանի գործողություններում ընդհանրապես հիմնավոր կասկածը բացակայում է, այդ կապակցությամբ դատարանի որոշումը ստանալուց հետո նոր կքննարկենք Վճռաբեկ բողոք ներկայացնելու հարցը»,- նշեց փաստաբանը։ 

Նրա խոսքով՝ Նազարյանի մասնակցությամբ այս ընթացքում որևէ քննչական գործողություն չի կատարվել, վարույթն իրականացնող մարմինը միայն մեկ անգամ է հրավիրել՝ քննչական խմբի նոր ղեկավարի հետ ծանոթացնելու համար։

Նշենք, որ Ռոբերտ Նազարյանը չի ընդունել իրեն առաջադրված մեղադրանքները և դրանք ապօրինի ու անհիմն է համարում։

Հավելենք, որ մեղսագրվող արարքի վրա տարածվում է համաներում, այն հիմքով, որ Էրեբունի-Երևանի հիմնադրման 2800-ամյակի և Հայաստանի առաջին Հանրապետության անկախության հռչակման 100-ամյակի կապակցությամբ ԱԺ-ի կողմից 2018 թ․ հայտարարված համաներումը կիրառվում է 60 տարին լրացած անձանց նկատմամբ, որոնք մեղադրվում են այնպիսի գործություններ կատարելու մեջ, որոնց համար նախատեսված է պատիժ ոչ ավելի, քան 6 տարի ժամկետով ազատազրկում։

Հիշեցնենք՝ քրեական գործով ՀՀ հանրային ծառայությունները կարգավորող հանձնաժողովի նախկին նախագահ Ռոբերտ Նազարյանին և ՀՀ հանրային ծառայությունները կարգավորող հանձնաժողովի նախկին անդամներ Շիրազ Կիրակոսյանին և Մուշեղ Կոշեցյանին, հանձնաժողովի նախագահի տեղակալ Նիկոլայ Գրիգորյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով՝ պաշտոնեական լիազորությունները չարաշահելու համար, որն առաջացրել է ծանր հետևանքներ։

Ըստ ՀՔԾ հաղորդագրության՝ քրեական գործի նախաքննության ընթացքում բավարար ապացույցներ են ձեռք բերվել, որ Ռոբերտ Նազարյանի և հանձնաժողովի վերը նշված անդամների գործողությունների պատճառով «Ձորագետ Հիդրո» ՍՊ ընկերության հիդրոէլեկտրակայանից արտադրված և առաքված էլեկտրական էներգիայի վաճառքի համար 2012-2019 թվականների ընթացքում սահմանվելիք սակագների փոխարեն նույն ժամանակահատվածների համար սահմանվել են կրկնակին գերազանցող սակագներ, որի հետևանքով «Ձորագետ Հիդրո» ՍՊ ընկերության կողմից ՀՀ-ում էլեկտրաէներգիա սպառող ֆիզիկական և իրավաբանական անձանցից հավելյալ ստացվել է առանձնապես խոշոր չափերի՝ 7,052,065,099 ՀՀ դրամ գումար:
