ԿԱՐԵՎՈՐ ՈՐՈՇՈՒՄ

ինքնակամ շինությունների օրինականացման վերաբերյալ

Սիրելի հայրենակիցներ, ինչպես գիտեք, այս տարվա հունվարի 1-ից ուժի մեջ են մտել անշարժ գույքի նոր՝ շուկայականին մոտարկված կադաստրային արժեքները, որոնք մի քանի անգամ գերազանցում են գործող արժեքները:

Դա առաջացրել է մի խնդիր՝ կապված ինքնակամ շինությունների օրինականացման հետ, որը վերաբերում է մեր հազարավոր հայրենակիցների:

Ո՞րն է այդ խնդիրը:

Մեր բազմաթիվ հայրենակիցներ դեռ անցած տարվանից դիմել են համայնքապետարաններ՝ իրենց կառուցած ինքնակամ շինությունները օրինականացնելու համար:

Եթե որոշումը դրական է՝ այսինքն շինությունը օրինականացվում է, ապա անշարժ գույքի տերը վճարում է այդ պահին գործող կադաստրային արժեքը:

Խնդիրն այն է, որ չնայած դիմումները եղել են մինչև 2020 թվականի դեկտեմբերի 31-ը, որոշումները կայացվելու են այս տարի: Եթե որոշումները կայացվեին ավելի արագ՝ մինչև 2020 թվականի ավարտը, ապա վճարվելու էր նախկին՝ ավելի ցածր կադաստրային արժեքներին համապատասխան գումար: Սակայն ստեղծված իրավիճակում դրական որոշման դեպքում նրանք ստիպված էին լինելու վճարել հունվարի 1-ից ուժի մեջ մտած բարձր կադաստրային արժեքը:

Մեր համաքաղաքացիներին այս դժվարություններից ազատելու համար՝ ԱԺ տնտեսական հարցերի մշտական հանձնաժողովի նիստում առաջարկվել է լրացում կատարել «Անշարժ գույքի հարկով հարկման նպատակով ան՛արժ գույքի շուկայական արժեքին մոտարկված կադաստրային գնահատման կարգը սահմանելու մասին» օրենքի մեջ, ըստ որի՝

Բոլոր այն անձինք, որոնք ինքնակամ շինությունների իրականացման համար ԴԻՄՈՒՄ կներկայացնեն ՄԻՆՉԵՎ 2021 ԹՎԱԿԱՆԻ ՀՈՒՆՎԱՐԻ 31-Ը, ապա դրական որոշման դեպքում ԿԳՈՐԾԵՆ ՆԱԽԿԻՆ (ավելի ցածր) ԿԱԴԱՍՏՐԱՅԻՆ ԱՐԺԵՔՆԵՐԸ:

Այնպես որ, ովքեր արդեն դիմել են ինքնակամ շինությունը օրինականացնելու համար, կարող են հանգիստ լինել՝ ԱՆԿԱԽ ՈՐՈՇՈՒՄԸ ԿԱՅԱՑՆԵԼՈՒ ՊԱՀԻՑ` նրանց համար կիրառվելու են նախկին կադաստրային արժեքները (լրացուցիչ ֆինանսական բեռ չի լինի):

Իսկ մեր այն հայրենակիցները, որոնք ունեն օրինականացման ենթակա ինքնակամ շինություններ, խորհուրդ կտայի ԴԻՄԵԼ համայնքապետարաններ և գործընթացը սկսել ՄԻՆՉև 2021 թվականի հունվարի 31-ը՝ ավելորդ ֆինանսական բեռից խուսափելու համար:
