ՀԱՂՈՐԴՈՒՄ ՀԱՆՑԱԳՈՐԾՈՒԹՅԱՆ ՄԱՍԻՆ

2021 թվականի ապրիլի 26-ին ՀՀ վարչապետի և կառավարության պաշտոնական կայքում ՀՀ նախկին վարչապետ Նիկոլ Փաշինյանը ներկայացված է իբրև ՀՀ վարչապետի պաշտոնակատար։ Նրա մասին տեղեկություններ չկա նաև կայքի «Երրորդ հանրապետության նախկին վարչապետեր» բաժնում։

ՀՀ նախկին վարչապետ, ՀՀ քաղաքացի Նիկոլ Փաշինյանը ապօրինի կերպով զավթել է Հայաստանի Հանրապետության վարչապետի պաշտոնը և իրականացնում է այդ պաշտոնից լիազորություններից բխող գործողություններ, չնայած այն հանգամանքին, որ նա 2021 թվականի ապրիլի 25-ին հրաժարական է ներկայացրել ՀՀ վարչապետի պաշտոնից, որից հետո Հանրապետության նախագահ Արմեն Սարգսյանը ստորագրել է թիվ ՆՀ-80-Ա հրամանագիրը, որով ընդունվել է Կառավարության հրաժարականը։

Ըստ այդմ՝ ՀՀ նախկին վարչապետ, ՀՀ քաղաքացի Նիկոլ Փաշինյանը կատարել է ՀՀ Քրեական օրենսգրքի 300 հոդվածի նախատեսված ենթադրյալ հանցագործության արարք։

Խնդրում եմ ՀՀ գլխավոր դատախազությանը և պատասխանատու այլ իրավապահ մարմիններին անհապաղ հարուցել քրեական գործ, գործի շրջանակներում ՀՀ նախկին վարչապետ Նիկոլ Փաշինյանին ներգրավել որպես մեղադրյալ և, հաշվի առնելով ենթադրյալ հանցագործի ազատության մեջ գտնվելու հանրային վտանգավորության աստիճանն ու նոր հանցագործությունների կատարելու ռիսկերը, դիմել դատարան՝ նրան նկատմամբ կալանավորումը որպես խափանման միջոց կիրառելու միջնորդությամբ։

Հոդված 300. Իշխանությունը յուրացնելը

  1. Իշխանությունը զավթելը` բռնություն գործադրելու կամ բռնություն գործադրելու սպառնալիքի միջոցով, ինչպես նաև Սահմանադրությամբ չնախատեսված այլ եղանակով Հանրապետության Նախագահի, Ազգային ժողովի, կառավարության կամ սահմանադրական դատարանի լիազորություններին տիրանալը`

պատժվում են ազատազրկմամբ` տասից տասնհինգ տարի ժամկետով:

  1. Իշխանությունը պահելը` Հանրապետության Նախագահի, պատգամավորի, վարչապետի, նախարարի լիազորությունների ավարտից հետո այդ լիազորությունների իրականացումը շարունակելը`

պատժվում է ազատազրկմամբ` տասից տասնհինգ տարի ժամկետով:

  1. Սույն հոդվածի առաջին մասով նախատեսված հանցագործության նախապատրաստության փուլում դրան մասնակցող անձի կողմից հանցագործության նախապատրաստության մասին իրավապահ մարմիններին կամավոր հայտնած անձն ազատվում է սույն հոդվածի առաջին մասով նախատեսված քրեական պատասխանատվությունից:
