2021թ. մայիսի 18-ին ՀՀ ոստիկանության անձնագրային և վիզաների վարչություն է դիմել Միհրան Սուրենի Պողոսյանի (ծնված 29.05.1976թ.) լիազորված անձ Նորայր Հարությունյանը՝ Միհրան Պողոսյանին վերջին չորս տարում միայն Հայաստանի Հանրապետության քաղաքացի հանդիսանալու և վերջին չորս տարում Հայաստանի Հանրապետությունում մշտապես բնակվելու մասին տեղեկանք (այսուհետ՝ տեղեկանք) ստանալու խնդրով: Դիմումին կից ներկայացրել է Մոսկվայի պոլիտեխնիկական համալսարանի 11.07.2020թ. թիվ 1360-ОД հրամանը՝ Միհրան Պողոսյանին նշված համալսարանում առկա ուսուցմամբ մագիստրատուրայի առաջին կուրս ընդունելու մասին:

«ՀՀ ընտրական օրենսգիրք» Սահմանադրական օրենքի 80-րդ հոդվածի 2-րդ մասով սահմանվել է, որ քաղաքացին վերջին չորս տարում Հայաստանի Հանրապետությունում մշտապես բնակվող չի համարվում, եթե լիազոր մարմնին դիմում տալու օրվան նախորդող 1.461 օրերի ընթացքում նա առնվազն 731 օր բացակայել է Հայաստանի Հանրապետությունից: Նույն նորմով սահմանվել է Հայաստանի Հանրապետությունից բացակայությունը հարգելի համարելու երկու հիմք, որոնցից է՝ արտերկրում բարձրագույն ուսումնական հաստատություններում ուսումնառությունը։ Ներկայացրած փաստաթղթերով նշված ժամկետի հաշվանցմամբ Միհրան Պողոսյանը դիմում տալու օրվան նախորդող 1.461 օրերից 753 օր բացակայել է Հայաստանի Հանրապետությունից, այսինքն՝ օրենքով սահմանված ժամկետը գերազանցվել է 22 օրով և նրան մերժվել է տեղեկանք տրամադրել։

2021թ. մայիսի 20-ին ՀՀ ԱՎ վարչությունում ստացվել է Միհրան Պողոսյանի լիազորված անձի երկրորդ դիմումը՝ տեղեկանք տրամադրելու հարցը կրկին քննարկելու խնդրանքով և ի հավելումն նախորդ փաստաթղթի ներկայացվել է Մոսկվայի պոլիտեխնիկական համալսարանի 15.01.2020թ. թիվ 0089- ОД հրամանը՝ 2020թ. հունվարի 25-ից մայիսի 31-ը Միհրան Պողոսյանին նշված համալսարանում նախապատրաստական դասընթացների ընդգրկելու մասին։

Ներկայացված հրամանների և տեղեկանքների իսկությունը պարզելու նպատակով 22.05.2021թ. հարցում է կատարվել Մոսկվայի պոլիտեխնիկական համալսարան:

Մինչ հարցման պատասխանը ստանալը, Միհրան Պողոսյանի լիազորված անձը հայց է ներկայացրել ՀՀ վարչական դատարան՝ տեղեկանքը տրամադրելուն պարտավորեցնելու պահանջով։

2021թ. մայիսի 25-ին դատարանն իր որոշման հիմքում դնելով նաև Մոսկվայի պոլիտեխնիկական համալսարանի՝ Միհրան Պողոսյանին նախապատրաստական դասընթացների ընդգրկելու մասին հրամանը բավարարել է հայցը, ՀՀ ոստիկանության անձնագրային և վիզաների վարչությանը պարտավորեցրել է տրամադրելու տեղեկանքը: Դատարանի վճիռը եղել է վերջնական, առանց բողոքարկման իրավունքի։ Ի կատարումն դատարանի վճռի՝ 25.05.2021թ. Միհրան Պողոսյանին տրվել է հայցվող տեղեկանքը:

Այնուհետև 26.05.2021թ. ՀՀ ոստիկանության անձնագրային և վիզաների վարչությունում ստացվել է Մոսկվայի պոլիտեխնիկական համալսարանի պատասխան գրությունը, որով նշվել է, որ Միհրան Պողոսյանը նախապատրաստական դասընթացների չի ընդգրկվել, ինչպես և հերքվել է Մոսկվայի պոլիտեխնիկական համալսարանի կողմից 15.01.2020թ. թիվ 0089- ОД հրամանն արձակելու և 21.05.2021թ. թիվ 1427 տեղեկանքը տրամադրելու փաստը։

ՀՀ ԱԺ արտահերթ ընտրություններին որպես պատգամավորի թեկնածու Միհրան Պողոսյանի գրանցումն առկախելու նպատակով նշված հանգամանքի վերաբերյալ անմիջապես տեղեկացվել է ՀՀ Կենտրոնական ընտրական հանձնաժողով, ծանուցվել է նաև Միհրան Պողոսյանի ներկայացուցիչը:
