2021թ. օգոստոսի 21-ին «Ինֆորմացիոն ազատության կենտրոն» հասարակական կազմակերպության նախագահ Շուշան Դոյդոյանը դիմում էր ներկայացել ՀՀ գլխավոր դատախազին, այն մասին, որ Երևան քաղաքի Աջափնյակ վարչական շրջանի Սիլիկյան թաղամասի հին խճուղի 60/1 հասցեի անմիջական հարևանությամբ շահագործվում է քարի արտադրամաս, որը գտնվում է համայնքային սեփականություն հանդիսացող ու բնակելի նշանակություն ունեցող հողատարածքի վրա և համայնքի ղեկավարը հանցավոր անգործություն է դրսևորել, հողի ապօրինի շահագործման փաստի առթիվ միջոցներ չի ձեռնարկել՝ խախատելով՝ «Տեղական ինքնակառավարման մասին» ՀՀ օրենքի 42-րդ հոդվածի 1-ին կետի 7-րդ և 9-րդ ենթակետերի պահանջները: Այս մաին տեղեկացնում է ՀՀ Դատախազությունը։

Իսկ ըստ ՀՀ կադաստրի պետական կոմիտեի տրամադրած տվյալների՝ հողամասի նպատակային նշանակությունը բնակավայրերի է, գործառնականը՝ բնակելի կառուցապատում, իսկ շահագործող Ա/Ձ-ի անվամբ անշարժ գույքի նկատմամբ իրավունքների պետական գրանցումներ առկա չեն:

Երևան քաղաքի Աջափնյակ և Դավթաշեն վարչական շրջանների դատախազության հանձնարարությամբ դիմումում նշված հանգամանքների կապակցությամբ ոստիկանությունում նախապատրաստվել են նյութեր, որի ընթացքում տվյալներ են ստացվել այն մասին, որ Երևան քաղաքի Սիլիկյան թաղամաս հին խճուղի 60/1 և 9/12 հասցեների անմիջական հարևանությամբ առկա է համայնքային սեփականություն հանդիսացող և բնակելի նշանակություն ունեցող հողատարածք, որտեղ անձը 2015 թվականից գրանցել է իր անվամբ Ա/Ձ և իրականացնում է քարե արտադրամասի գործունեություն։ Վերջինս 2018-2019թթ. դիմել է Երևանի քաղաքապետարան՝ հողատարածքի նկատմամբ սեփականության իրավունք ձեռք բերելու համար, իսկ 27.05.2021թ. դիմել է ՀՀ վարչական դատարան, որը որոշում է կայացրել հայցի ապահովման միջոց կիրառել:

Նկատի ունենալով, որ նախապատրաստված նյութերում առերևույթ առկա են հանցագործության հատկանիշների առկայության մասին վկայող տվյալներ և անհրաժեշտ է նշված հանգամանքները պարզել լրիվ, օբյեկտիվ և բազմակողմանի քննության միջոցով, Երևան քաղաքի Աջափնյակ և Դավթաշեն վարչական շրջանների դատախազությունում ՀՀ քրեական օրենսգրքի 3152-րդ հոդվածի հատկանիշներով հարուցվել է քրեական գործ: Նախաքննությունը հանձնարարվել է ՀՀ  ՔԿ  ԵՔՔՎ  Աջափնյակ  և  Դավթաշեն  վարչական  շրջանների  քննչական  բաժնին:
