«Փաստ» օրաթերթը գրում է

Ընտանեկան հարաբերություններին վերաբերող ամենատարբեր խնդիրներին անդրադառնալու առիթներ «Փաստն» ունեցել է:

Օրինակ՝ փաստաբանների հետ քննարկել ենք ամուսնալուծության դեպքում երեխաների հետ տեսակցության հարցերը՝ ինչպես են դրանք լուծվում, եթե ծնողները չեն կարողանում համաձայնություն ձեռք բերել: Բայց պարզվում է, որ այս հարցում խնդիրներ են առաջանում նաև մյուս հարազատների հետ երեխաների շփման ժամանակ: Ինչպե՞ս վարվել, երբ պապիկները և տատիկները ցանկանում են շփվել իրենց թոռների հետ, իսկ ծնողները կամ նրանցից մեկն արգելում է կամ արհեստական խոչընդոտ ստեղծում:

Փաստաբան Վերոնիկա Ալեքսանյանը նշում է, որ հաճախ են հանդիպում դեպքեր, երբ ամուսինների ամուսնալուծությունից հետո այն ծնողը, ում հետ բնակվում են երեխաները, առերևույթ, կամայական արգելում է ամուսնու ծնողներին տեսակցություն կամ որևէ այլ հաղորդակցություն թոռների հետ կամ ստեղծում է խոչընդոտներ:

«Տվյալ պարագայում հարց է առաջանում՝ ինչպե՞ս լուծել ստեղծված իրավիճակը: Նշենք, որ ՀՀ ընտանեկան օրենսգրքի համաձայն՝ երեխան ունի իր ծնողների, պապերի և տատերի, եղբայրների, քույրերի, ինչպես նաև այլ ազգականների հետ շփվելու իրավունք: Անգամ ծնողների ամուսնության դադարեցումը, այն անվավեր ճանաչվելը կամ նրանց առանձին ապրելը չեն ազդում երեխայի իրավունքների վրա: Ինչպես տեսնում ենք, երեխայի պապերը, տատերը, եղբայրները, քույրերը և այլ ազգականներն իրավունք ունեն շփվելու երեխայի հետ:

Նշենք նաև, որ ըստ ՀՀ ընտանեկան օրենսգրքի՝ մերձավոր ազգականների հետ երեխային շփվելու հնարավորություն տալուց ծնողների կամ նրանցից մեկի մերժման դեպքում խնամակալության և հոգաբարձության մարմինը կարող է պարտավորեցնել ծնողներին կամ նրանցից մեկին՝ չխանգարելու այդ շփմանը, իսկ եթե ծնողները կամ նրանցից մեկը չեն կատարում խնամակալության կամ հոգաբարձության մարմնի որոշումը, ապա երեխայի մերձավոր ազգականները կարող են երեխայի հետ շփվելու արգելքները վերացնելու հայցով դիմել դատարան:

Ըստ ՀՀ օրենսդրության՝ երեխայի պապերը, տատերը, եղբայրները, քույրերը և այլ ազգականներն իրավունք ունեն շփվելու անչափահաս երեխաների հետ: Այն դեպքում, երբ ծնողները հրաժարվում են պապին կամ տատին հնարավորություն տալ շփվելու թոռների հետ, խնամակալության և հոգաբարձության մարմինները կարող են ծնողներին պարտավորեցնել՝ հնարավորություն տալու պապին ու տատին տեսակցելու թոռների հետ, այդ մարմինների կողմից սահմանված կարգով, եթե այդպիսի տեսակցությունները չեն խանգարի երեխայի նորմալ դաստիարակությանը և նրա վրա վնասակար ազդեցություն չեն գործի»,-«Փաստի» հետ զրույցում ասում է փաստաբանը:

Ընդգծում է՝ եթե ծնողները կամ նրանցից մեկը չեն կատարում խնամակալության և հոգաբարձության մարմնի որոշումը, երեխայի մերձավոր ազգականները կարող են երեխայի հետ շփվելու արգելքները վերացնելու հայցով դիմել դատարան: «Դատարանը վեճը լուծում է` ելնելով երեխայի շահերից: Նշենք, որ երեխաների նկատմամբ բոլոր գործողություններում, անկախ այն բանից, թե դրանք ձեռնարկվում են սոցիալական ապահովության հարցերով զբաղվող պետական կամ մասնավոր հիմնարկների, դատարանների, վարչական կամ օրենսդրական մարմինների կողմից, առաջնահերթ ուշադրություն պետք է դարձվի հենց երեխայի լավագույն շահերին։ Եվ ի վերջո, ամուսնալուծված ամուսինները պետք է հասկանան, որ պապերը և տատերը նույնպես իրավունք ունեն շփվելու իրենց թոռների հետ, և վերջիններիս այդ իրավունքը տրված է ՀՀ օրենսդրությամբ»,-եզրափակում է Վերոնիկա Ալեքսանյանը:
