Դատական իշխանությունը կատարյալ մարմին չէ, ինչպես կատարյալ չեն իշխանության մյուս ճյուղերը, այնուամենայնիվ՝ ես այս երեք տարիների ընթացքում, երբ գործադիր ու օրենսդիր մարմինների կողմից խոսվում է վեթինգի մասին, չհասկացա`վեթինգը ի՞նչ է, լինելո՞ւ է, թե՞ չի լինելու։ Այս մասին լրագրողների հետ զրույցում ասաց Վերաքննիչ դատարանի դատավոր Մխիթար Պապոյանը։

Հարցին`չունի արդյոք մտավախություն, որ կարող է ընդգրկված լինել իշխանության կողմից հայտարարված 40 «ոչ ցանկալի» դատավորների ցանկում, Պապոյանը պատասխանեց. «Ես բացարձակ որևէ բանի մտահոգություն չունեմ, այդ թվում՝ աշխատանքը կորցնելու մտավախություն։ Տարբեր ժամանակ տարբեր դատավորների մասին է խոսվել, ես էլ ցանկանում եմ հասկանալ՝ որտեղից է գալիս այդ տեղեկատվությունը, որ այս կամ այն դատավորը հայտնվել են այդ ցուցակում, ինչ են արել։ Եթե դրանք օպերատիվ տեղեկություններ են, ինչու օպերատիվ մարմինը հետևողական գործողություններ չի անում, եթե ոչ օպերատիվ տեղեկություններ են, այսպես ասած. ասեկոսեներ են, ապա դրա արդյունքում գնահատական տալ դատավորներին, կարծում եմ սխալ է։ Սրա մասին է խոսքը: Եթե Արդարադատության նախարարը իր աշխատասենյակում նստած ինչ-որ դատական ակտերին գնահատական տալով է գալիս այդպիսի եզրահանգման, մեկ ուրիշ խնդիր է, եթե օպերատիվ մարմինների տեղեկատվություն է, ապա ինչու է այդ մարմնի տեղեկատվությունը հասնում Արդարադատության նախարարին»։

Պապոյանը նշեց, որ ակնառու է այն հանգամանքը, որ որոշակի հայտարարությունների պատճառով դատական իշխանության վարկանիշը նվազել է։

«Ես ուզում եմ հասկանալ, թե երկու տարի տևած իմ հետ կապված քրեական գործը ինչ ելք է ունենալու։ Այս քրեական գործից միայն ունեմ այն տեղեկությունը, որ կասեցվեց, ապա վերսկսեց քննությունը։ Ինչ են քննում, ում և ինչի վերաբերյալ, ես չգիտեմ։ Վերջում ես խոստանում եմ՝ իմ գնահատականը կտամ։ Ինձ այս գործը չի հետաքրքրում, ինչի համար պետք է հետաքրքրի, եթե ինձ հետ ոչ մի կապ չունի: Այնքանով է հետաքրքրում, որ այս գործի շրջանակներում իմ նկատմամբ որոշակի գործողություններ են իրականացվել, այդ թվում՝ գաղտնալսում։ Բոլոր նրանք, ովքեր խախտել են իմ սահմանադրական իրավունքը, պատասխան են տալու։ Ես գիտեիմ, ով է թույլատրել գաղտնալսումը, բայց դեռ չեմ ուզում շտապել»։

Հարցին՝ ինչպես է վերաբերվում այն հանգամանքին, որ ԱԱԾ-ի կողմից մի քանի ամիս առաջ առգրավվել մակագրման համակարգիչը, Պապոյանը պատասխանեց.

«Դրան վերաբերվում եմ ժպիտով»։
