«Հայաստանում նոր օրենսդրական նախաձեռնությամբ նախատեսվում է ոչ ռեզիդենտ կազմակերպությունների կողմից մատուցվող էլեկտրոնային ծառայությունները հարկել ավելացված արժեքի հարկով»: «Հայաստանի Հանրապետության հարկային օրենսգրքում փոփոխություններ կատարելու մասին օրենքի նախագիծն ԱԺ նիստում ներկայացրեց ՊԵԿ նախագահ Ռուստամ Բադասյանը:

«Այս նախագծով ներդնում ենք  էլեկտրոնային ծառայությունների հարկումը, եթե այդպիսի ծառայությունները մատուցվում են ոչ ռեզիդենտ ընկերության կողմից ֆիզիկական անձին, և այնպիսի ոչ ռեզիդենտ կազմակերպության կողմից, որոնք ՀՀ-ում չունեն մշտական հաստատություն: Այսինքն, հարկում ենք բիզնեսից դեպի ֆիզիկական անձ մատուցվող էլեկտրոնային ծառայությունները, որոնք մատուցվում են ոչ ռեզիդենտ կազմակերպության կողմից՝ առանց ՀՀ-ում մշտական հաստատության»,-ասաց Բադասյանը:

Այս նախագծով երեք հիմնական հարց է կարգավորում կառավարությունը. նախ, սահմանվում է էլեկտրոնային ծառայությունների հասկացությունը, երկրորդը՝ սահմանվում է, թե ինչպես է որոշվելու՝ ծառայությունների մատուցման վայրը ՀՀ-ում է, թե ոչ, և ոչ ռեզիդենտ կազմակերպության կողմից ֆիզիկական անձին մատուցվող էլեկտրոնային ծառայությունների մասով ԱԱՀ հաշվարկելու և վճարելու առանձնահատկությունները:

Ըստ նախագծի՝ էլեկտրոնային եղանակով ծառայությունների մատուցում է համարվում տեղեկատվական և հեռահաղորդակցական ցանցի միջոցով ծառայությունների մատուցումը՝ այդ թվում՝ համացանցի միջոցով, որի մատուցումն անհնար է առանց տեղեկատվական տեխնոլոգիաների օգտագործման, և որոնց ցանկը սահմանելու է կառավարությունը:

«Խոսքը չի գնում այնպիսի ապրանքների մասին, որոնք ձեռք են բերվում էլեկտրոնային հարթակով և մատակարարվում են ֆիզիկապես: Խոսքը բացառապես այնպիսի էլեկտրոնային ծառայությունների մասին  է, որի մատուցումը հնարավոր է միայն համացանցի հեռահաղորդակցական ցանցի միջոցով»,-ասաց Բադասյանը:

Այդպիսի ծառայություններն են, օրինակ, տեղեկատվական հեռահաղորդակցման կապով, այդ թվում՝ ինտերնետով գովազդային ծառայությունների մատուցումը, ինչպես նաև՝ գովազդային հարթակների տրամադրումը, ինտերնետով կրթության ոլորտի ծառայությունների մատուցումը, էլեկտրոնային գրքերից օգտվելու վճարովի ծառայությունները, ֆիլմեր դիտելու համար նախատեսված ծառայությունները, «Ֆեյսբուք»-ում ֆիզիկական անձի կողմից գովազդ տեղադրելը: Այդ բոլոր դեպքերում ոչ ռեզիդենտ խոշոր ընկերությունները հաշվարկելու և վճարելու են ավելացված արժեքի հարկ:
