Ինտերնետ շահումով խաղերի գովազդի սահմանափակման եվրոպական փորձը

Ինչպես գիտեք՝ գովազդի մասին ՀՀ օրենքում նախատեսվող փոփոխությունների արդյունքում Հայաստանի Հանրապետությունում պետք է ամբողջությամբ արգելվի վիճակախաղերի (տոտալիզատորների) և ինտերնետ շահումով խաղերի գովազդը։ Նախագծի հեղինակները, որպես հիմնավորում նման ծայրահեղ քայլի՝ ի թիվս այլ փաստարկների, բերում են նաև եվրոպական երկրների փորձը։

Սակայն «եվրոպական փորձի» ամենամակերեսային հետազոտությունն անգամ ցույց է տալիս, որ վիճակախաղերի (տոտալիզատորների) և ինտերնետ շահումով խաղերի գովազդը չի արգելվում այն երկրների բացարձակ մեծամասնությունում, որտեղ դրանք կազմակերպելու գործունեությունը թույլատրված է օրենքով։ Այսինքն՝ եթե տվյալ երկրում թույլատրվում է կազմակերպել, օրինակ՝ առցանց կազինո խաղեր, ապա գովազդել այդ նույն խաղերը տվյալ երկրում նույնպես թույլատրվում է։  Որոշ դեպքերում կիրառվում են տարատեսակ սահմանափակումներ, ինչպիսիք են՝ գովազդի հեռարձակման տևողությունը, խաղամոլության վերաբերյալ նախազգուշացումները և այլն: Սակայն ի սպառ արգելել գովազդել գործունեության մի տեսակ, որը միանգամայն թույլատրելի է և օրինական՝ եվրոպացիների մտքով դեռևս չի անցել։  

Արևմուտքում ընդամենը գործում են ողջամիտ սահմանափակումներ։ Մասնավորապես, մի շարք երկրներում առկա են հեռուստատեսությամբ կամ ռադիոյով գովազդի սահմանափակումներ միայն որոշակի ժամերի համար (Գերմանիա, Միացյալ թագավորություն, Իսպանիա, Պորտուգալիա, Նիդերլանդներ)։ Երկրների մեկ այլ հատվածում առկա են նաև համացանցով գովազդի հստակ և մասնակի սահմանափակումներ, այն է՝ գովազդի թույլտվություն միայն սպորտային տեղեկատվության տրամադրմամբ մասնագիտացած կայքերում (Ռուսաստան)։ Կա նաև վիրտուալ սլոթերի, առցանց կազինոյի և առցանց պոկերի գովազդի արգելք ժամը 6:00-ից 21:00-ն (Գերմանիա)։ Ընդ որում՝ անգամ այն երկրներում, որտեղ վիճակախաղերի, շահումով խաղերի գովազդի արգելք է սահմանված, այդ արգելքը չի տարածվում տոտալիզատորների գովազդի վրա (Էստոնիա)։

Եվրոպական երկրների գերակշռող մեծամասնությունում սահմանափակումները վերաբերում են գովազդում տրամադրվող տեղեկատվության բովանդակությանը և մատուցման ձևերին, ինչպես նաև հասանելիությանը անչափահասներին։ 

Միևնույն ժամանակ, «Պատասխանատու խաղի» կանոնակարգումները, որոնք հենց Եվրոպայում համարվում են խաղացողների իրավունքների պաշտպանության հիմնական և ամենաարդյունավետ միջոցը, կարող են դառնալ փայլուն այլընտրանք գովազդի արգելքին: Օրենսդրական փոփոխությունները պետք է միտված լինեն ոչ թե առհասարակ խաղերի մասնակցությունը սահմանափակելուն կամ արգելելուն, այլ, օրինակ՝ «Պատասխանատու խաղի» կանոնակարգումներ ներդնելուն և խաղերը որպես ժամանցի տեսակ, այլ ոչ թե խաղամոլության կամ գումար աշխատալու միջոց ընկալվելուն։
