«Լուսավոր Հայաստան» կուսակցության նախագահ, իրավաբան Էդմոն Մարուքյանն իր ֆեյսբուքյան էջում գրել է․

«Այսօր Մարդու իրավունքների եվրոպական դատարանից ստացված գրությամբ տեղեկացանք, որ Ադրբեջանի Հանրապետությունը Բադալյանն ընդդեմ Ադրբեջանի գործով սահմանված ժամկետում ՄԻԵԴ Մեծ պալատ բողոք չի ներկայացրել ընդդեմ կայացված որոշման, ինչի արդյունքում որոշումը մտել է օրինական ուժի մեջ։

Դատարանը նշել է նաև, որ սույն որոշման կատարման ապահովումը Եվրոպայի խորհրդի նախարարների կոմիտեի գործառույթն է։ Հիշեցնեմ, որ «Բադալյանն ընդդեմ Ադրբեջանի (գանգատ թիվ 51295/11)» գործով վճիռը կայացվել էր 2021 թվականի հուլիսի 22-ին։

Սույն գործով Եվրոպական դատարանն արձանագրել էր, որ Ադրբեջանի կառավարությունը չէր տրամադրել համոզիչ և բավարար բացատրություն առ այն, որ Արթուր Բադալյանի հոգեկան առողջության լուրջ խնդիրները, որոնք ի հայտ էին եկել անազատությունից ազատվելուց անմիջապես հետո, որևէ կերպ կապված չեն պահման պայմանների և այն վերաբերմունքի հետ, որը Բադալյանն ստացել էր անազատության գտնվելու ընթացքում:

Այսպիսով, Եվրոպական դատարանը եզրահանգել էր, որ տեղի է ունեցել ՄԻԵԿ 3-րդ հոդվածի խախտում, այն է՝ «Ոչ ոք չպետք է ենթարկվի խոշտանգումների կամ անմարդկային կամ նվաստացնող վերաբերմունքի կամ պատժի»։ Ավելին, Եվրոպական դատարանը, նշել էր, որ Ադրբեջանի կառավարությունը որևէ նյութ կամ որևէ տեղեկատվություն չէր ներկայացրել՝ ապացուցելու Բադալյանի ռազմագերի լինելու հանգամանքը։

Այլ փաստարկներ չէին բերվել առ այն, որ Կոնվենցիայի 5-րդ հոդվածը չի տարածվում Բադալյանի գործի վրա, և Ադրբեջանը չէր պնդել, որ Բադալյանի կալանավորումը համապատասխանում էր ՄԻԵԿ 5-րդ հոդվածի 1-ին մասի 1-ին կետին կամ որ Բադալյանին տրամադրվել էր որևէ ընթացակարգային երաշխիք:

Այսպիսով, Եվրոպական դատարանը եզրահանգել էր, որ տեղի է ունեցել նաև ՄԻԵԿ 5-րդ հոդվածի 1-ին մասի 1-ին ենթակետի խախտում, այն է՝ «Յուրաքանչյուր ոք ունի ազատության և անձնական անձեռնմխելիության իրավունք։ Ոչ ոքի չի կարելի ազատությունից զրկել այլ կերպ, քան սույն հոդվածում սահնանված դեպքերում և օրենքով սահմանված կարգով»: Սույն գործով ՄԻԵԴ-ը պարտավորեցրել է Ադրբեջանի Հանրապետությանը Բադալյանին վճարել 30.000 եվրո՝ որպես բարոյական վնասի փոխհատուցում»։
