ՊՇՌ թեստավորման պահանջը շարունակում է ուժի մեջ մնալ, չպատվաստված աշխատողները պարտավոր են իրականացնել թեստավորում: Այս մասին ասված է ՀՀ կառավարության ֆեյսբուքյան պաշտոնական էջում արված հայտարարության մեջ:

Սահմանադրական դատարանի որոշմամբ ՀՀ առողջապահության նախարարի 2021 թվականի օգոստոսի 20-ի N 65-Ն հրամանը ճանաչվել է սահմանադրական։ Նախարարի հրամանով սահմանված ՊՇՌ թեստավորման պահանջն օրինական է, քանի որ այն բխում է հանրային առողջապահական շահից։
Սահմանադրական դատարանի կողմից առղջապահության նախարարի հրամանի բոլոր հավելվածների՝ «ՊՇՌ թեստավորումն իրականացնում է աշխատողն իր հաշվին» նախադասության մեջ հակասահմանադրական է ճանաչվել միայն «իր հաշվին» բառակապակցությունը, ինչն ամենևին չի վերացնում աշխատողների՝ ՊՇՌ թեստ ներկայացնելու պահանջը։

Չի նախատեսվում արտոնյալ և անվճար պայմաններով ապահովել չպատվաստված աշխատողների ՊՇՌ թեստավորումը, հետևաբար նախարարի հրամանից ելնելով՝ չպատվաստված աշխատողներն ամեն դեպքում պարտավոր են իրականացնել թեստավորում և իրավական կարգավորումներով նախատեսված ընթացակարգերով ներկայացնել թեստավորման արդյունքները գործատուին։
