ՀՀ ՊՆ ՌՈ ՔՀԲ-ում ստացված օպերատիվ տեղեկություններն իրացնելիս, ձեռնարկված օպերատիվ-հետախուզական միջոցառումների արդյունքում բացահայտվել են ենթադրյալ ապօրինություններ։ 12.11.2020թ. քաղաքացի Խ.Ա.-ի դուստրը՝ Ա.Ա.-ն, դիմում է ներկայացրել «Մարտական գործողությունների ընթացքում գերեվարված, անհետ կորած զինծառայողների և այլ անձանց» հանձնաժողովին, որում նշել է, թե իր հայրը, որն, ըստ նրա՝ մասնակցել է 44-օրյա պատերազմին, տնից դուրս է եկել և այլևս տեղեկություն չեն ունեցել նրանից: Դիմումի հիման վրա Խ.Ա.-ն ընդգրկվել է անհետ կորած զինծառայողների և կամավորագրված անձանց անվանացանկում: Այս մասին հայտնում են ՊՆ-ից։

30.07.2021թ. Ա.Ա.-ն դիմել է Կոտայքի մարզի առաջին ատյանի ընդհանուր իրավասության դատարան /դատական գործ Կ/Դ8867/02/21/ Խ.Ա.-ին անհայտ բացակայող ճանաչելու հայցով և դատարանում հայտարարել, որ հայրը կամավոր մասնակցել է 2020թ․ 44-օրյա պատերազմին ու նրա վերաբերյալ երկար ժամանակ տեղեկություններ չունի: 22.11.2021թ. նույն դատարանի վճռով Խ.Ա.-ն ճանաչվել է անհայտ բացակայող և համաձայն «Հայաստանի Հանրապետության պաշտպանության ժամանակ զինծառայողների կյանքին կամ առողջությանը պատճառված վնասների հատուցման մասին» օրենքի՝ Խ.Ա.-ի գծով շահառուներ են ճանաչվել նրա դստրերը՝ Ա.Ա.-ն և Ա.Ա.-ն և յուրաքանչյուրին վճարվել է 5.000.000 ՀՀ դրամ, որպես միանվագ գումար և 500.000 ՀՀ դրամ՝ որպես 2022թ․ մարտ-հունիս ժամանակահատվածի ամսական վճար, ընդհանուրը՝ 11.000.000 ՀՀ դրամ:

ՊՆ ՌՈ ՔՀԲ աշխատակիցների ձեռնարկած օպերատիվ-հետախուզական միջոցառումների արդյունքում պարզվել է, որ Խ.Ա.-ն 2020թ. 44-օրյա պատերազմի ընթացքում չի զորակոչվել, չի կամավորագրվել և չի զոհվել: Խ.Ա.-ն հայտնաբերվել է Արցախի Հանրապետության Մարտակերտի շրջանում և պարզաբանել, որ դեռևս 2019թ. հուլիսին իր դստրերին տեղեկացրել է, որ մեկնում է Արցախի Հովտաշեն համայնք՝ մշտական բնակության: Խ.Ա.-ն հայտնել է նաև, որ 44-օրյա պատերազմին չի մասնակցել:

Հաշվի առնելով, որ Ա.Ա.-ի, Ա.Ա.-ի և ՊՆ պաշտոնատար անձանց արարքներում առերևույթ ի հայտ են եկել ՀՀ քրեական օրենսգրքի 255-րդ /խարդախություն/ և 550-րդ /զինվորական պաշտոնեական անփութություն/ հոդվածներով նախատեսված հանցագործության հատկանիշներ՝ համապատասխան փաստաթղթերն ուղարկվել են ՀՀ ՔԿ ԶՔԳՎ՝ հետագա ընթացքը որոշելու համար:
