ՀՀ ԱԺ մարդու իրավունքների պաշտպանության եւ հանրային հարցերի մշտական հանձնաժողովի նախագահ, անկուսակցական Թագուհի Թովմասյանը գրում է. Ադրբեջանի հանցավոր վարչակազմը հերթական անօրինական որոշմամբ 2022թ․ հունվարից արգելել է Ադրբեջանի կողմից օկուպացված Արցախի շրջաններում անհայտ կորած հայ զինծառայողների և քաղաքացիական անձանց մարմինների որոնողական աշխատանքները՝ փորձելով հոգեկան տառապանքներ պատճառել համայն հայությանը։

2020թ․ նոյեմբերի 10-ի և 2021թ․ հունվարի 11-ի՝ Հայաստանի, Ռուսաստանի և Ադրբեջանի առաջնորդների հայտարարություններով ամրագրված է առաջնային կարևորություն ունեցող հումանիտար խնդիրների հրատապ կարգավորումը, այդ թվում՝ «ռազմագերիների, պատանդների և պահվող այլ անձանց ու մահացածների մարմինների փոխանակումը»: Սակայն Ադրբեջանը հերթական անգամ միակողմանիորեն ոտնահարում է միջպետական պայմանավորվածությունները՝ միաժամանակ հարվածելով նաև միջազգային մարդասիրական իրավունքի հիմնարար նորմերին, որոնք ամրագրված են «Պատերազմի զոհերի պաշտպանության մասին» Ժնևի 1949թ. չորս կոնվենցիաներում և «Միջազգային զինված կոնֆլիկտների զոհերի պաշտպանության վերաբերյալ» Ժնևի 1949 թվականի օգոստոսի 12-ի կոնվենցիաներին կից՝ Ժնևի՝ 1977 թվականի լրացուցիչ արձանագրությամբ, երկու լրացուցիչ արձանագրություններով, որոնք զինված հակամարտության ժամանակ մարդու պաշտպանությանն ուղղված կանոնների համակարգ են։

Մարդու իրավունքների եվրոպական կոնվենցիան անդամ պետությունների միջև ստեղծում է փոխադարձ նախաձեռնությունների և օբյեկտիվ պարտավորությունների համակցություն, և գործում է փոխադարձության սկզբունքը: Ակնհայտ է միջազգային մարդասիրական իրավունքի դրույթների կատարման հրամայականը, ուստի հերթական դիմումներս եմ ուղղում միջազգային գործընկերներիս՝ դատապարտելու Ադրբեջանի այս հանցավոր վարքագիծը և ձեռնարկելու համապատասխան միջոցառումներ՝ ի պաշտպանություն անհայտ կորած հայ զինծառայողների և քաղաքացիական անձանց, նրանց ընտանիքների հիմնարար իրավունքների։

Ադրբեջանի այս հանցավոր վարքագիծը օբյեկտիվ հարց է առաջացնում․ եթե Ադրբեջանը չի կատարում նույնիսկ միջազգային մարդասիրական իրավունքի պահանջները, ինչու՞ է Նիկոլ Փաշինյանը կյանքի կոչում Ի․Ալիևի պահանջները։ Ադրբեջանի կողմից այս հումանիտար պահանջների չկատարումն իրականում ընդդիմանալու և պահանջատիրոջ դիրքերից հանդես գալու հնարավորություն է ընձեռում՝ ի պաշտպանություն հումանիտար իրավունքի։ Սակայն Նիկոլ Փաշինյանը անհասկանալի դրդապատճառներով չի անում։
