ԱՆԻՖ հիմնադրամը արձագանքել է Տիգրան Ավինյանի ` ապօրինի պաշտոնավարման մասին լուրերին

Ի արձագանք մամուլում շրջանառվող լուրերի` հարկ ենք համարում պարզաբանել, որ Տիգրան Ավինյանի կողմից Հայաստանի պետական հետաքրքրությունների ֆոնդի` ԱՆԻՖ-ի, խորհրդի նախագահի կարգավիճակում պաշտոնավարումը  իրավական տեսանկյունից լիովին համատեղելի է և տրամաբանական Երևանի փոխքաղաքապետի կարգավիճակի հետ։

Այսպես. «Հանրային ծառայության մասին» ՀՀ օրենքի 31-րդ հոդվածի 6-րդ մասի համաձայն «Հանրային պաշտոն զբաղեցնող անձը կամ հանրային ծառայողը կարող է ընդգրկվել 50 և ավելի տոկոս ՀՀ մասնակցությամբ առևտրային կազմակերպության տնօրենների խորհրդի (դիտորդ խորհուրդ) կազմում, եթե դա ուղղակիորեն առնչվում է իր պաշտոնավարման ոլորտի քաղաքականության իրականացման հետ առանց վարձատրության կամ որևէ այլ ձևով փոխհատուցում ստանալու կամ հանրային պաշտոն չզբաղեցնող անձանց կամ ոչ հանրային ծառայողների համար նախատեսված սոցիալական երաշխիքներից կամ այլ ծառայություններից կամ արտոնություններից օգտվելու իրավունքի»։

ԱՆԻՖ-ի ընթացիկ, առայժմ չհայտարարված, ինչպես նաև ապագա֊քննարկվող ծրագրերի մեծ մասը ուղիղ կապ ունի Երևանի զարգացման ծրագրերի հետ: Այդ թվում են քաղաքացիների շարժունակության, ենթակառուցվածքների, տուրիզմի, սպասարկման, շինարարության,կառուցապատման և այլ բնագավառները։

ԱՆԻՖ-ի կողմից իրականացվող ծրագրերի զգալի մասի արդյունավետությունը և իրացվելիությունը ուղիղ կապ ունեն Երևանի քաղաքապետարանի գործառույթների հետ։ Այս պահին քննարկման փուլում են Երևանում ԱՆԻՖ-ի կողմից նոր ներդրումների ներգրավման մի քանի ծրագրեր, որոնք գտնվում են քաղաքապետարանի անմիջական գործառույթների տիրույթում։ Հետևաբար, փոխքաղաքապետի կարգավիճակի հետ համատեղությունը ԱՆԻՖ-ի անկախ վերահսկող մարմնում ինչպես չի հակասում օրենքին, այնպես էլ նպաստում է պետության ներդրումային և առկա ծրագրերի իրականացման համադրմանը։ Այս է, ի դեպ, հենց ԱՆԻՖ-ի առաքելությունը։

Նկատի ունենալով, որ ԱՆԻՖ-ի 100%-ի մասնաբաժինը պատկանում է Հայաստանի Հանրապետության կառավարությանը, ինչպես նաև, հաշվի առնելով այն հանգամանքը, որ Տիգրան Ավինյանը ԱՆԻՖ-ում չի կատարում վճարովի աշխատանք, ԱՆԻՖ-ի խորհրդի նախագահի և Երևանի փոխքաղաքապետի պաշտոնների իրավական անհամատեղելիության ու հակադրության մասին խոսք լինել չի կարող։
