Արդարադատության նախարարությունն առաջարկում է փոփոխություն կատարել կառավարության 2010 թ. փետրվարի 18-ի N 146-Ն որոշման մեջ: 2022 թ. դեկտեմբերի 7-ին ընդունված «Հանրային ծառայության մասին օրենքում» լրացումներ և փոփոխություններ կատարելու մասին»» օրենքով և հարակից օրենքներով տեղի ունեցան ոլորտային օրենսդրական փոփոխություններ, որոնց շրջանակներում կարգավորվեցին նաև հանրային պաշտոն զբաղեցնող անձանց և հանրային ծառայողների պաշտոնական պարտականությունների իրականացման հետ կապված նվերների ինստիտուտի կատարելագործմանը և նվերների հաշվառման գործընթացի նկատմամբ վերահսկողության գործիքակազմի սահմանմանն ուղղված հիմնահարցերը:

Մասնավորաբար, «Հանրային ծառայության մասին» օրենքի 30-րդ հոդվածի 4-րդ մասի համաձայն՝ նվերների հաշվառման, հանձնման և գնահատման, ռեեստրի վարման կարգերը, ռեեստրում լրացման և հրապարակման ենթակա տվյալների ցանկը, ներկայացված տվյալներում փոփոխությունների կատարման, նվերների ընդունման սահմանափակումների խախտման դեպքերի վերաբերյալ տեղեկությունների տրամադրման կարգերը, ինչպես նաև խորհրդատվական կարծիքի տրամադրման մեթոդական ուղեցույցը սահմանում է Կոռուպցիայի կանխարգելման հանձնաժողովը: «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքում փոփոխություններ և լրացում կատարելու մասին» 2022 թ. դեկտեմբերի 7-ի ՀՕ-556-Ն օրենքի 73-րդ հոդվածի 12-րդ մասի համաձայն՝ նվերների հաշվառման և հանձնման կարգը սահմանում է Կոռուպցիայի կանխարգելման հանձնաժողովը:

Զուգահեռ, «Սահմանադրական դատարանի մասին» սահմանադրական օրենքում փոփոխություններ և լրացում կատարելու մասին» 2022 թ. դեկտեմբերի 7-ի ՀՕ-557-Ն սահմանադրական օրենքի 4-րդ հոդվածով սահմանվեցին ՍԴ դատավորի՝ նվերներ ընդունելու սահմանափակումները։ Օրենքներն ուժի մեջ են մտել 2023 թ. հունվարի 2-ին: «Հանրային ծառայության մասին» օրենքի անցումային դրույթներով նախատեսվեց, որ դրանցից բխող ենթաօրենսդրական նորմատիվ իրավական ակտերը կառավարությունն ընդունում է օրենքն ուժի մեջ մտնելուց հետո մեկ տարվա ընթացքում: ՀՀ վարչապետի՝ 2023 թ. մարտի 29-ի N 349-Ա որոշմամբ սահմանվեց օրենքների կիրարկման համար անհրաժեշտ ենթաօրենսդրական իրավական ակտերի շրջանակը: Նախագիծն ապահովելու է օրենքների կիրարկումը, որի արդյունքում դատավորների նվերների հաշվառման և հանձնման կարգը սահմանելու է Կոռուպցիայի կանխարգելման հանձնաժողովը:
