«Ժողովուրդ». Մարդու իրավունքների եվրոպական դատարանն ուշագրավ որոշում է կայացրել

«Ժողովուրդ» օրաթերթը գրել էր, որ Մարդու իրավունքների եվրոպական դատարանը ուշագրավ որոշում է կայացրել ՀՀ-ում լիազորությունները դադարեցված 7 դատավորների մասով՝ նրանց բոլորի գործերը իրար միացնելու եւ մեկ վարույթում քննելու ձեւաչափով: Մասնավորապես, լիազորությունները դադարեցված 7 դատավորները՝ Ռուբեն Վարդազարյանը, Ալեքսեյ Սոքոյանը, Զարուհի Նախշքարյանը, Աննա Փիլոսյանը, Սուրեն Անտոնյանը եւ Սիմա Ոսկանդարյանը, Ռաֆայել Մելքոնյանը, դիմել են ՄԻԵԴ՝ բողոքելով, որ իրենց լիազորությունները դադարեցվել են իրավունքների կոպտագույն խախտումներով:

Եվ, ահա, Եվրոպական դատարանը դատավորների գանգատը ընդունել է վարույթ, բոլոր դատավորների գործերը միացվել ու քննվելու են մեկ վարույթում։ ՄԻԵԴ-ի այս որոշումը աննախադեպ է այն առումով, որ, ըստ էության, Եվրոպական դատարանը հասկացել է, որ կա խախտում, եւ առաջնահերթության սկզբունքով է քննելու լիազորությունները դադարեցրած դատավորների գործը։ Սա ենթադրել է տալիս՝ նոր «ապտակ» է սպասվում Բարձրագույն դատական խորհրդին։

Ի դեպ, մեզ հասած լուրերի համաձայն՝ ՄԻԵԴ-ը դատավորների դիմումը վարույթ ընդունելու եւ առաջնահերթությամբ 7 դատավորների հարցը մեկ վարույթում քննելու մասին անգամ տեղեկացրել է ԲԴԽ-ին։

«Ժողովուրդ» օրաթերթը դիմեց ՀՀ բարձրագույն դատական խորհուրդ՝ տեղեկությունը պարզելու համար, սակայն ի պատասխան՝ ԲԴԽ-ից հայտնեցին. «Մենք որեւէ բան ՄԻԵԴ-ից չենք ստացել եւ որեւէ գործառույթ չունենք նման հարցերը իրենց հետ քննարկելու»։

Զարմանալի է, բայց ԲԴԽ-ն ակնհայտ ստում է, քանի որ «Ժողովուրդ» օրաթերթի ձեռքում կա փաստաթուղթ, թե ինչպես է Մարդու իրավունքների եվրոպական դատարանում Հայաստանի Հանրապետության ներկայացուցիչ Եղիշե Կիրակոսյանը ՄԻԵԴ որոշման մասին գրություն ուղարկել ե՛ւ ԲԴԽ նախագահ Անդրեասյանին, ե՛ւ արդարադատության նախարար Գրիգոր Մինասյանին՝ ըստ էության պահանջելով բացատրություններ»:
