«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունը հանրային քննարկման է ներկայացրել «Ոստիկանության գվարդիայի մասին» և հարակից օրենքների նախագծերը: Նշվում է, որ ներկայում ոստիկանության զորքերի խնդիրները, գործունեության իրավական հիմքերն ու սկզբունքներն առավելապես կանոնակարգված են «Ոստիկանության զորքերի մասին» օրենքով։

«Պաշտպանության մասին» օրենքը ոստիկանության զորքերը դասում է «այլ զորքերի» թվին, ինչի ուժով՝ դրա ղեկավարման և կառավարման գործառույթները խաղաղ ժամանակ օրենքով սահմանված կարգով իրականացնում է ներքին գործերի նախարարությունը, իսկ ռազմական դրության կամ պատերազմի ժամանակ զորքերն անցնում են ԶՈւ-ի հրամանատարության օպերատիվ ենթակայության ներքո։ Այլ զորքերի մեջ ներառվելու հետևանքով ոստիկանության զորքերի վրա տարածվում են նաև Զինված ուժերի ներքին ծառայության կանոնագրքի և ԶՈւ կայազորային ու պահակային ծառայությունների կանոնագրքի դրույթները։

Այսպիսով, ինչպես ոստիկանության զորքերը, այնպես էլ դրանց ծառայողներն ունեն երկակի կարգավիճակ, այս ծառայությանը բնորոշ է ինչպես ներքին, այնպես էլ արտաքին անվտանգության գործառույթների զուգակցումը, ինչը չի բխում ոստիկանության ընդհանուր խնդիրներից։ «Ոստիկանության գվարդիայի մասին» նոր օրենքը սահմանելու է ոստիկանության գվարդիայի նոր կարգավիճակը, կառուցվածքը, ոստիկանության գվարդիայի ծառայողների իրավունքներն ու պարտականությունները, ներառյալ՝ նրանց կողմից ուժային միջոցներ կիրառելու դեպքերը, հիմքերը և այլն։

Օրենքի մակարդակով կնախատեսվեն այն հատուկ միջոցները, որոնք լիազորված են լինելու կիրառել ոստիկանության գվարդիայի ծառայողները օրենքով վերապահված խնդիրների և գործառույթների ապահովման շրջանակներում: Ոստիկանության գվարդիան լինելու է ՀՀ ոստիկանության կառուցվածքային միավոր՝ իր տարածքային և ոլորտային ստորաբաժանումներով և այլևս չի ներառվելու «այլ զորքեր» օրենսդրական հասկացության մեջ։ Նոր օրենքով ոստիկանության գվարդիային կվերապահվեն երկրի պաշտպանության ոլորտի այնպիսի գործառույթներ, որոնք բխում են ոստիկանության խնդիրներից և արդյունավետ կերպով կարող են իրականացվել նոր ձևավորվող ծառայության կողմից: Նախագծի ընդունմամբ նաև պետբյուջեում կառաջանան ծախսեր, որոնք ճշգրտման փուլում են։

Այսպիսով՝ կստեղծվի զուտ ոստիկանական ծառայություն՝ միջազգային ստանդարտներին համապատասխանող նոր սպառազինությամբ ու վերապատրաստված անձնակազմով, որին կվերապահվեն հասարակական կարգի պահպանության և հասարակական անվտանգության ապահովման, պետական շենքերի և կարևորագույն օբյեկտների պահպանության, պետական արարողակարգով նախատեսված պատվիրակությունների ուղեկցման, ինչպես նաև ռազմական և արտակարգ դրության իրավական ռեժիմի ապահովման ու այլ գործառույթներ։
