ԱՄՆ դատարանը Թրամփի մաքսատուրքերը հակասահմանադրական է ճանաչել

Նյու Յորքի դաշնային դատավորն ԱՄՆ  նախագահ Դոնալդ Թրամփին արգելել է, արտակարգ իրավիճակների մասին օրենքի հիման վրա, լայնածավալ առևտրային մաքսատուրքեր սահմանել այլ երկրների նկատմամբ: Դատարանի որոշման մեջ ասվում է, որ նման միջոցները «հակասահմանադրական են» և այլևս չեն կարող կիրառվել: Սա ներառում է գրեթե բոլոր մաքսատուրքերը, որոնք նախկինում սահմանել է Թրամփի վարչակազմը, գրում է Bild-ը:

Դատարանն ընդգծել է, որ Սահմանադրությամբ արտաքին առևտուրը կարգավորելու իրավասությունը պատկանում է բացառապես Կոնգրեսին, ոչ թե նախագահին։ Ըստ դատարանի՝ պետության ղեկավարը կարող է ինքնուրույն գործել միայն «արտառոց սպառնալիքի» առկայության դեպքում, ինչը դատարանը չի տեսել այս դեպքում։

Ավելին, դատարանը չի ճանաչել որևէ ազգային արտակարգ իրավիճակի առկայությունը, որը կարող էր արդարացնել նման միջոցները: Թրամփի վարչակազմն արդեն բողոք է ներկայացրել։ Այժմ գործը պետք է քննի Վերաքննիչ դատարանը։ Մեկնաբանելով որոշումը՝ Սպիտակ տան խոսնակ Քուշ Դեսաին ասել է. «Չընտրված դատավորներն իրավասություն չունեն որոշելու, թե ինչպես պատշաճ կերպով արձագանքել ազգային արտակարգ իրավիճակին»: Նա հավելել է, որ վարչակազմը մտադիր է օգտագործել «գործադիր իշխանության բոլոր լծակները՝ այս ճգնաժամը լուծելու համար»:
