2012 թվականին ԵԽԽՎ-ի ընդունած 1900 բանաձևը հստակ սահմանում է՝ ով կարող է համարվել քաղաքական բանտարկյալ։ Ըստ այդ հինգ չափանիշների՝ անձը քաղաքական բանտարկյալ է, եթե նրա կալանավորումն իրականացվել է խոսքի, համոզմունքների կամ հավաքների ազատության խախտմամբ, իրականացվել է բացառապես քաղաքական շարժառիթներով, եղել է անհամաչափ, խտրական կամ անարդար դատավարական գործընթացի արդյունք։

Ստորև ներկայացնում եմ այդ չափանիշները․

ա) եթե կալանավորումն իրականացվել է Մարդու իրավունքների եվրոպական կոնվենցիայի և նրա արձանագրությունների մեջ արտացոլված հիմնարար երաշխիքների, մասնավորապես` մտքի, խղճի և կրոնի ազատության, արտահայտվելու եւ տեղեկատվության ազատության, հավաքների և միավորումների ազատության երաշխիքներից որևէ մեկի խախտմամբ:

բ) եթե կալանավորումը կատարվել է բացառապես քաղաքական պատճառով, առանց որևէ հանցանքի հետ կապելու:

գ) եթե քաղաքական շարժառիթներով կալանավորման ժամկետը կամ պայմանները ակնհայտորեն անհամաչափ են արարքին, որի համար անձը ճանաչվել է կասկածյալ կամ մեղադրյալ:

դ) եթե քաղաքական շարժառիթներով անձը կալանավորվել է խտրականորեն՝ համեմատած այլ անձանց հետ:

ե) եթե կալանավորումն ակնհայտորեն անարդար ընթացակարգերի արդյունք է, ինչը կապված է իշխանությունների քաղաքական շարժառիթների հետ:

Այս չափանիշները հիմք ընդունելով՝ ակնհայտ է, որ Սամվել Կարապետյանի և Միքայել Սրբազանի պարագայում մենք գործ ունենք հենց քաղաքական հետապնդման փաստի հետ։ Նրանք հետապնդվում են ոչ թե որևէ հանցագործության, այլ իրենց արտահայտած կարծիքի, հարցազրույցների և հայտնած տեսակետի համար։ Միքայել Սրբազանի նկատմամբ երկու տարվա ազատազրկման հապճեպ դատավճիռը և Սամվել Կարապետյանի ապօրինի քրեական հետապնդումն ու կալանավորումը վկայում են այն մասին, որ Հայաստանում ձևավորվել է վտանգավոր իրավիճակ՝ իշխանությունների վարած քաղաքականության դեմ ձայների լռեցման և մարդու իրավունքների, ժողովրդավարության և իրավունքի գերակայության արժեքների ոտնահարման միջոցով։

Այս փաստերի համադրմամաբ հստակ կարող ենք ասել, որ այս դեպքերը ժողովրդավարական հետընթացի հստակ ցուցիչ են և խոսքի ազատության բացահայտ ոտնահարում։
