Էկոնոմիկայի նախարարությունը պարզաբանում է, թե ինչու է արգելվել որոշ ապրանքների ներմուծումը:
Պարզաբանման մեջ մասնավորապես ասվում է.
Հայաստանի Հանրապետության կողմից ոչ սակագնային կարգավորման միջոցների կիրառումը բխում է «Եվրասիական տնտեսական միության մասին» պայմանագրի համապատասխան դրույթներով սահմանված պահանջներին համապատասխանեցնելու անհրաժեշտությունից:
Մասնավորապես` «Եվրասիական տնտեսական միության մասին» պայմանագրով նախատեսվում են որոշակի սահմանափակումներ եւ արգելքներ երրորդ երկրներից դեպի ԵՏՄ երկրներ ներմուծելու եւ ԵՏՄ երկրներից դեպի երրորդ երկրներ որոշակի ապրանքախմբեր արտահանելու համար:
Այդ սահմանափակումները արտահայտվում են նրանով, որ մի շարք առանձնահատուկ ապրանքախմբերի համար երրորդ երկրներից դեպի ԵՏՄ ներմուծումը եւ (կամ) ԵՏՄ-ից դեպի երրորդ երկրներ արտահանումը արգելվում է, իսկ սահմանափակման ենթակա ապրանքների նկատմամբ պետք է իրականացվի լիցենզիաների կամ թույլտվությունների հիման վրա, որոնք պետք է տրամադրեն տվյալ երկրի համապատասխան լիցենզավորող մարմինները:
Այդ սահմանափակումները կրում են պարտադիր բնույթ եւ պետք է կիրառվեն ԵՏՄ անդամ բոլոր պետությունների կողմից` առանց որեւէ բացառությունների: Արգելքները կամ սահմանափակումները մասնավորապես վերաբերում են քաղաքացիական եւ ծառայողական զենքի, թմրանյութերի, վտանգավոր թափոնների, հազվագյուտ կենդանիների ու բույսերի եւ այլ առանձնահատուկ ապրանքատեսակների նկատմամբ (ապրանքների ամբողջական ցանկը ներկայացված է ՀՀ էկոնոմիկայի նախարարության կայքէջում` Եվրասիական միության անդամ պետությունների կողմից երրորդ երկրների հետ առեւտրի դեպքում արգելված եւ սահմանափակումների ենթակա ապրանքների ցանկ վերնագրի ներքո` http://www.mineconomy.am/arm/556/gortsaruyt.html հղումով Եվրասիական տնտեսական հանձնաժողովի կայք` http://www.tsouz.ru/db/entr/norm-prav-doc/ediniy_perechen/Pages/default.aspx):
Նշված կարգավորումները կիրառվում են ԵՏՄ անդամ պետությունների շուկայի, տեղական արտադրողի, պետության, շրջակա միջավայրի, մարդկանց անվտանգության պաշտպանության ապահովման, միջազգային համաձայնագրերով ստանձնած պարտավորությունների կատարման նպատակով եւ ուղղված են ԵՏՄ անդամ պետությունների կողմից միասնական ու հավասարակշռված արտաքին տնտեսական քաղաքականության իրականացմանը:
ԵՏՄ-ի ապրանքախմբերում ընդգրկված զգալի մասով ապրանքների նկատմամբ Հայաստանում սահմանափակումներ կիրառվել են մինչ ԵՏՄ-ին անդամակցելը, այդ թվում` նաեւ միջազգային համաձայնագրերով ստանձնած պարտավորությունների կատարման համար:
Վերոհիշյալ միասնականությունն ապահովելու նպատակով Հայաստանի Հանրապետության կառավարության որոշմամբ սահմանվել են յուրաքանչյուր ապրանքախմբի մասով ՀՀ լիազոր պետական կառավարման մարմիններ (լիազոր մարմիններ), որոնք պետք է համակարգեն յուրաքանչյուր ապրանքախմբի մասով լիցենզավորման գործընթացները: Դրա հետ մեկտեղ նույն որոշմամբ հաստատվել են արգելքների եւ սահմանափակումների ենթակա ապրանքախմբերի ցանկերը եւ սահմանափակման ենթակա ապրանքախմբերի արտահանման կամ ներմուծման համար լիցենզիաների կամ թույլտվությունների ստացման ընթացակարգերը:
Լիազոր մարմինների կողմից կհաստատվեն այդ ապրանքախմբերում ներառված ապրանքների ցանկերն ըստ ԱՏԳ ԱԱ ծածկագրերի եւ լիցենզավորման ընթացակարգերը, որտեղ հստակ նկարագրված կլինի լիցենզավորման ողջ գործընթացը (ներկայացվող փաստաթղթերի անվանումները, ներկայացման վայրը, լիցենզիաների կամ թույլտվությունների տրամադրման ժամկետներն ու պայմանները):
Նշված ցանկերն ու ընթացակարգերը կհաստատվեն տվյալ ոլորտը համակարգող լիազոր մարմնի գերատեսչական իրավական ակտով, որտեղ մանրամասն կնշվի նաեւ, թե որ ապրանքախմբերի նկատմամբ են սահմանված սահմանափակումներ միայն արտահանման կամ ներմուծման համար եւ որ ապրանքների նկատմամբ` արտահանման եւ ներմուծման համար:
Նշված ցանկերում հաշվի են առնվել ԵՏՄ անդամ պետությունների ներքին շուկայի պաշտպանման առանձնահատկությունները եւ սահմանվել են կարգավորման միջոցներ, որոնք կիրառվում են միայն կոնկրետ տվյալ պետության համար: Մասնավորապես` արգելվել է Ղազախստանից որոշակի կոնկրետ տեսակի փայտանյութի արտահանումը:
