Գյումրիում տեղի ունեցած սահմռկեցուցիչ դեպքերից հետո, վերջնականապես պարզ դարձավ, որ Հայաստանը` որպես պետություն, այլևս միայն ձևականորեն է գործում: Պետությունը միջազգային հարաբերությունների ամենագլխավոր սուբյեկտն է: Պետությունը` որպես հասարակության քաղաքական համակարգի հիմնական ինստիտուտ, ունի որոշակի հատկանիշներ, որով տարբերվում է հասարակության քաղաքական համակարգի այլ սուբյեկտներից: Այդ հատկանիշներն են.
1.Ինքնիշխանությունը, որը նշանակում է, որ պետության տարածքում կառավարությունը իրականացնում է ինքնուրույն ներքին և արտաքին քաղաքականություն:
2.Իրավունքի առկայությունը, առանց որի չի կարող իրականացվել պետությունը, քանի որ միայն իրավունքն է իրավաբանորեն ձևավորում պետական իշխանությունը, դարձնում է այն լեգիտիմ և որոշում է պետական գործառույթների իրականացման ձևերն ու շրջանակները:3.Օրեքներ ընդունելու բացառիկ իրավունքը, որը կլինի պարտադիր ամբողջ բնակչության համար:4.Պետական իշխանությունների կողմից (բանակ, ոստիկանություն, դատարան, հատուկ ծառայություններ և այլն) բռնության լեգիտիմ միջոցներ իրակականացնելու մենաշնորհ ունենալը և այլն:
Սակայն Սերժ Սարգսյանի ռեժիմի վարած քաղաքականության հետևանքով Հայաստանում չի գործում պետության այս հատկանիշներից և ոչ մեկը: Հայաստանը չի կարող ինքնուրույն լուրջ որոշումներ իրականացնել միջազգային ասպարեզում՝ առանց Մոսկվայի հետ համաձայնեցման: Երկրում չկա օրենքի և իրավունքի գերակայություն: Շատ հաճախ օրենքները որոշ արտոնյալ մարդկանց դեպքում չեն գործում, իսկ ոչ յուրայինների դեպքում էլ գործում են խստորեն: Հայաստանում շատ հաճախ է խախտվում քաղաքացիների ընտրական, ազատ տեղաշարժվելու, սեփականության և այլ իրավունքները: Չկա անկախ դատական համակարգ, դատարանները ենթարկվում են իշխող կլանին: Իշխանությունները ձևականորեն են ընտրվում ժողովրդի կողմից, սակայն իրականում նրանց նշանակում է Ռուսաստանի նախագահը:
Գյումրիի սպանության ժամանակ պարզվեց նաև, որ ռուսական ռազմաբազայի զինվորները` զենքերը ձեռքերին, ՀՀ տարածքում զբաղվում են որոնողական աշխատանքներով, որի իրավունքը նրանք չունեին: Դրանով պետք է զբաղվեին մեր իրավապահները: Հիմա էլ Ռուսաստանը կարծես թե չի ցանկանում, որ իր մարդասպան զինվորը դատվի և իր պատիժը կրի Հայաստանում, որի տարածքում իրականացվել է հանցագործությունը և ըստ Հայաստանի և Ռուսաստանի միջև կնքված ռուսական ռազմաբազայի մասին պայմանագրի` նա պետք է դատվի և իր պատիժը կրի Հայաստանում: Այնպես որ, կարելի է ասել, որ ՀՀ երրորդ հանրապետությունը միայն ձևականորեն է անկախ և ինքնիշխան հանրապետություն և պետք է զբաղվել ՀՀ չորրորդ հանրապետության ստեղծմամբ:
