Զանգվածային լրատվամիջոցներում առկա հրապարակումների հիման վրա Հայաստանի Հանրապետության փաստաբանների պալատի նախագահ Արա Զոհրաբյանի 19.01.2015թ. թիվ 12-Աորոշմամբ կարգապահական վարույթ է հարուցվել փաստաբան Թամարա Յայլոյանի նկատմամբ։
Զանգվածային լրատվամիջոցի հրապարակման համաձայն՝ փաստաբան Թամարա Յայլոյանը՝ իր հարցազրույցում հայտնել է, որ Վալերի Պերմյակովին իրավական օգնություն է ցույց տվել Շիրակի մարզի քննչական վարչության պետի տեղակալի հրավերով
. իր հարցազրույցում հայտնել է, որ հրաժարվել է Վալերի Պերմյակովին իրավական օգնություն ցույց տալուց
. հրապարակել է Վալերի Պերմյակովի ցուցմունքները։ Փաստաբանի վարքագծի կանոնագրքի 3.1.9 ենթակետի համաձայն՝ Փաստաբանը չի կարող ընդունել նախաքննության և դատաքննության փուլերում տվյալ գործով վարույթ իրականացնող պաշտոնատար անձի կողմից իրեն ուղղված՝ տվյալ վարույթին առնչվող անձի գործի վարման հետ կապված իրավական օգնություն ցույց տալու հանձնարարություն:
Նույն կանոնագրքի 3.8.3 ենթակետի համաձայն՝ փաստաբանը, եթե օրենքը չի արգելում և այլ բան նախատեսված չէ պայմանագրում, իրավունք ունի հրաժարվել իրավական օգնություն ցույց տալու պայմանագրի կատարումից հետևյալ հիմքերով’
1) վստահորդը փաստաբանի պարզաբանումներին հակառակ կատարում է գործողություններ կապված հանձնարության հետ, որոնք օրենքով արգելված են,
2) վստահորդը պնդում է ակնկալվող արդյունքի ձեռքբերումը, որը օբյեկտիվորեն դարձել է անհնար’ նոր ի հայտ եկած հանգամանքների կամ փաստերի բերումով, 3) վստահորդը թույլ է տալիս իրավական օգնություն ցույց տալու պայմանագրով իր ստանձնած պարտավորությունների կոպիտ խախտումներ,
4) հանձնարարության պատշաճ կատարումը անհնար է դառնում վստահորդի կողմից փաստաբանի խորհուրդներին հակառակ գործողություններ կատարելու հետևանքով,
5) վստահորդը կատարում է փաստաբանի պատիվը, արժանապատվությունը և հեղինակությունը անվանարկող գործողություններ,
6) վստահորդը հրաժարվում է կատարել իրավական օգնություն ցույց տալու պայմանագրով նախատեսված վճարումները: Կարգապահական վարույթ հարուցելու մասին որոշմամբ պետք է ստուգման ենթարկվի Թամարա Յայլոյանի՝ Վալերի Պերմյակովին իրավական օգնությունը Շիրակի մարզի քննչական պետի տեղակալի հրավերով ցույց տալու, ինչպես նաև նրա կողմից Վալերի Պերմյակովին իրավական օգնություն ցույց տալուց հրաժարվելու վարքագծի համապատասխանությունը Փաստաբանի վարքագծի կանոնագրքի պահանջներին։ Թամարա Յայլոյանի կողմից Վալերի Պերմյակովի ցուցմունքները 17.01.2015թ. հրապարակելու մասով կարգապահական վարույթ չի հարուցվել, քանի որ ավելի վաղ՝ 13.01.2015թ. ժամը 09:40-ին արդեն իսկ ցուցմունքները հրապարակված են եղել Հայաստանի Հանրապետության ոստիկանապետի առաջին տեղակալ Հունան Պողոսյանի հետ նույն http://news.am լրատվական կայքի թղթակցի հետ ներկայացված զրույցի արդյունքում՝ «Գյումրիում ընտանիքի սպանության մեջ կասկածվողը սկսել է ցուցմունք տալ. մանրամասներ» հրապարակման մեջ:
Տեղեկացնում ենք, որ կարգապահական վարույթ հարուցելուց հետո գործը հանձնվում է կարգապահական գործ նախապատրաստողին, որի եզրակացությունը ստանալուց հետո Թամարա Յայլոյանի վարքագծի վերջնական գնահատականը տալու է ՀՀ փաստաբանների պալատի խորհուրդը (12 անդամի կազմով)։
Հ.Գ. Հարկ է արձանագրել, որ փաստաբանի նկատմամբ կարգապահական վարույթ հարուցելն ինքնին չի նշանակում, որ փաստաբանը թույլ է տվել կարգապահական խախտում և այդ հարցի վերջնական պատասխանը կարող է տրվել միայն կարգապահական վարույթի իրականացման արդյունքում’ ՀՀ փաստաբանների պալատի խորհրդի համապատասխան որոշմամբ:
