ՀՀ հատուկ քննչական ծառայությունում քննվող քրեական գործի նախաքննությամբ պարզվել և հիմնավորվել է, որ ՀՀ Լոռու մարզի ընդհանուր իրավասության դատարանի դատավոր Խաչատուր Խաչատրյանը 2014թ. հուլիսի 23-ին կայացրած որոշմամբ վարույթ է ընդունել բանկի կողմից «Զոսեկար» ՍՊԸ-ին հարկադրված սնանկ ճանաչելու մասին դիմումը և 2014թ. հոկտեմբերի 2-ին վճիռ կայացրել ՍՊԸ-ին սնանկ ճանաչելու վերաբերյալ:

2014թ. հոկտեմբերի 2-ի դրությամբ «Զոսեկար» ՍՊԸ-ի պարտքը բանկի հանդեպ կազմել է շուրջ 517 մլն 940 հազ. ԱՄՆ դոլար, իսկ ՍՊԸ-ի պարտավորությունների կատարումն ապահովված է եղել անշարժ գույքի գրավադրմամբ: Դատավորը սնանկության հետագա գործընթացում ինչպես իր լիազորությունների շրջանակում հիշյալ ՍՊԸ-ի տնօրեն Ս. Կարապետյանի օգտին գործողություններ կատարելու, այնպես էլ պաշտոնից բխող հեղինակությունն ու ազդեցությունն օգտագործելով` ՍՊԸ-ի վարկային պարտավորությունների կատարումն ապահովելու նպատակով բանկում գրավադրված անշարժ գույքն աճուրդի եղանակով վաճառքի գործընթացը մինչև 2015թ. մարտ երկարաձգելու, այդ կերպ` Ս. Կարապետյանին գրավադրված գույքը ձեռք բերելու հնարավորություն ընձեռելու դիմաց 2014թ. նոյեմբերին նրանից պահանջել է առանձնապես խոշոր չափերով` 10 հազ. ԱՄՆ դոլար կաշառք: Դատավորի կողմից առանձնապես խոշոր չափերով կաշառք ստանալու պահանջին ՍՊ ընկերության տնօրենը համաձայնել է:

Վերջինիս հետ կայացած մյուս հանդիպումների ժամանակ դատավոր Խ. Խաչատրյանը ավելացրել է սահմանված կաշառքի չափը և 2014թ. դեկտեմբերի 20-ին պահանջել ու 2014թ. դեկտեմբերի 25-ին` ժամը 18.30-ի սահմաններում, հիշյալ դատարանի իր աշխատասենյակում Ս. Կարապետյանից անձամբ ստացել է առանձնապես խոշոր չափերով` 9 մլն 186 հազ. ՀՀ դրամին համարժեք 20 հազ. ԱՄՆ դոլար կաշառք, որից անմիջապես հետո տեղում բռնվել է ԱԱԾ աշխատակիցների կողմից:

Հիշեցնենք, որ դատավոր Խաչատուր Խաչատրյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 2-րդ և 3-րդ կետերով, և վերջինիս նկատմամբ մինչդատական վարույթում որպես խափանման միջոց ընտրվել է կալանավորումը: ՀՀ հատուկ քննչական ծառայությունում քրեական գործի նախաքննությունն ավարտվել է, և գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու և դատարան ուղարկելու համար:
