Ինչո՞ւ է փոփոխությունների անհրաժեշտություն առաջացել «Մեղվաբուծության մասին» օրենքում. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Էկոնոմիկայի նախարարությունն առաջարկում է փոփոխություն կատարել «Մեղվաբուծության մասին» օրենքում։ Օրենքն ընդունվել է 2009 թվականին, սակայն դրանից ի վեր ոլորտում տեղի են ունեցել էական փոփոխություններ և զարգացումներ, որոնք պայմանավորել են գործող օրենսդրության վերանայման և կատարելագործման անհրաժեշտությունը։ Մասնավորապես, օրենքում լիազոր մարմնի վերաբերյալ առկա ձևակերպումները այլևս չեն համապատասխանում Հայաստանի կառավարության ներկայիս կառուցվածքին և գործառույթների բաշխմանը։ Բացի այդ, օրենքի մի շարք դրույթներ շարադրված են ընդհանուր և ոչ բավարար հստակությամբ, ինչը սահմանափակում է ոլորտի գործունեության արդյունավետ կարգավորման և պետական կառավարման լիարժեք իրականացման հնարավորությունները։

Միաժամանակ, մեղվաբուծությունը Հայաստանում անասնաբուծության կարևոր և հեռանկարային ճյուղերից մեկն է, որն ունի ինչպես գյուղատնտեսական արտադրության զարգացման, այնպես էլ գյուղական համայնքների սոցիալ-տնտեսական կայունության ապահովման համար կարևոր նշանակություն։ Հետևաբար՝ ոլորտի իրավական կարգավորումների արդիականացումն ու հստակեցումը կնպաստեն մեղվաբուծության զարգացմանը, տեղական արտադրության խթանմանը, արտադրանքի մրցունակության բարձրացմանը և արտահանման հնարավորությունների ընդլայնմանը։

Օրենքի նախագծով առաջարկվում է նաև հստակեցնել ոլորտի համար պատասխանատու պետական լիազոր մարմինը, որի միջոցով կիրականացվի մեղվաբուծության զարգացմանն ուղղված պետական քաղաքականության ձևավորումն ու իրականացումը, ինչպես նաև ոլորտի զարգացմանը և խթանմանը միտված ծրագրերի մշակումը և իրականացումը։

Միաժամանակ, օրենքի նախագծով նախատեսվում է լրացնել նոր հոդվածներ, որոնք վերաբերում են մեղվանոցների գործունեության կարգավորմանը, մեղվափեթակների հաշվառմանը և մեղվաբուծության ոլորտում վերահսկողության իրականացմանը։ Բացի այդ, մի շարք հասկացությունների ներառումը հնարավորություն կտա առավել հստակ սահմանել մեղվանոցներում իրականացվող տոհմասելեկցիոն աշխատանքների բնույթը, ինչպես նաև կնպաստի ոլորտում գիտահետազոտական գործունեության զարգացմանը։

Օրենքի նախագծի ընդունման արդյունքում կհստակեցվի մեղվաբուծության ոլորտի համար պատասխանատու պետական լիազոր մարմինը, կկատարելագործվի ոլորտը կարգավորող իրավական դաշտը և կսահմանվեն մեղվաբուծության ոլորտում վերահսկողության իրականացման առավել հստակ մեխանիզմներ, կճշգրտվի մեղվանոցներում իրականացվող տոհմասելեկցիոն աշխատանքների բնույթը և դրանց իրականացման շրջանակները։
