Պարզեցվում են Հայաստանի և Հունաստանի միջև կրկնակի հարկումից խուսափելու դրույթները

Հայաստանի և Հունաստանի նախատեսվում է կնքել «Եկամուտների և գույքի հարկերի առնչությամբ կրկնակի հարկումը բացառելու և հարկումից խուսափելը կանխելու կոնվենցիայում փոփոխություններ և լրացումներ կատարելու մասին» արձանագրություն: Փաստաթղթին հավանություն տալու մասին հարցն ընդգրկված է ՀՀ կառավարության փետրվարի 24-ի նիստի օրակարգում:  

Ըստբ ՀՀ ֆինանսների նախարարության, նշված արձանագրությամբ նախատեսվող փոփոխությունների և լրացումների կատա­րումը պայմանավորված է մի շարք հանգամանքներով, մասնավորապես 1999 թվա­կանից ի վեր ՀՀ տնտեսական և իրավական համակարգերում տեղի են ունեցել արմա­տական փոփո­խու­թ­յուններ, ինչպես նաև փոփոխությունների են ենթարկվել կրկնակի հարկման համա­ձայ­նագ­րերի կնքման համար հիմք հանդիսացող ՏՀԶԿ հարկային համա­ձայնագ­րերի մոդե­լային տարբերակի դրույթները: Վերանայվել են անկախ գործունեություն իրականացնելու դեպքում ստացված եկա­ մուտ­ների հարկման մոտեցումները՝ համապատասխանեցնելով ՏՀԶԿ հարկային համա­ձայ­նագ­րերի մոդելային տարբերակի դրույթներին:

Հիմնավորման համաձայն` արձանագրության նախագծով հստակեցվում են անշարժ գույքից ստաց­վող եկա­մուտների տեսակները: Կապիտալի հավելաճի հարկման վերաբերյալ դրույթները համա­­­պատասխանեցվել են ՏՀԶԿ հարկային համաձայնագրի մոդելային տարբերակի դրույթ­­ներին, մասնավորապես կարգավորվել է մի պայմանավորվող պետության ռեզի­դենտի կողմից բաժնետոմսերի օտարումից ստաց­ված արժեքի հավելաճի հարկման առանձնահատկությունները, եթե այդ բաժնետոմսերը ստացվել են մյուս պայմանավորվող Կողմի պետու­­թյունում գտնվող անշարժ գույքից:

Արձանագրությամբ նախատեսվում է փոփոխություն կատարել նաև այլ եկամուտների հարկման ընթացակարգերում, այն է՝ այլ եկամուտների որոշ տեսակների հարկման իրավասությունը վերապահվել է եկամտի ստացման աղբյուր երկրին: Մասնավորապես, մի պայմա­նավորվող կողմի պետության ռեզիդենտը մյուս պայմանավորվող կողմի պետության աղբյուրներից վիճակախաղերից, խաչբառերից, արշավներից, ձիարշավներից, խաղա­քար­տերից կամ ցանկացած այլ բնույթի շահումով խաղերից եկամուտներ ստանալու դեպքում, վերջին­ներս  կարող են հարկվել այդ մյուս պայմանավորվող կողմի պետությունո ւմ:

Մյուս փոփոխությամբ պարզեցվել են տեղեկությունների փոխանակման ընթացա­կար­գերը, մասնավորապես բանկային կամ այլ ֆինանսական հաստատությունների տրա­մադ­րու­թյան տակ գտնվող տեղեկությունների փոխանակման ընթացակարգերը:
