ԿԳՄՍ նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որի ընդունման անհրաժեշտությունը պայմանավորված է օտարերկրյա պետությունների բուհերում միջպետական համաձայնագրերով սովորողների իրավունքների պաշտպանության հանգամանքով, սպորտի զարգացման, ինչպես նաև պարտադիր զինվորական ծառայությունից ազատվելու տարիքային շեմ սահմանելու հանգամանքով: Նախագծի 1-ին կետի 1-ին ենթակետով նախատեսված կարգավորման համար հիմք է հանդիսացել այն, որ կառավարության 2018 թ.-ի N 450-Ն և N 457-Ն որոշումներով սահմանվել են սպորտի ու մշակույթի և արվեստի բնագավառներում նշանակալի նվաճումներ ունեցող քաղաքացիներին պարտադիր զինվորական ծառայության զորակոչից տարկետում տալու կարգը և պայմանները:

Նշված իրավական ակտերի համապատասխան կետերով քաղաքացուն տրվում է տարկետում 2-ից առավելագույնը 4 տարի ժամկետով, սակայն ոչ ավելի, քան մինչև քաղաքացու 26 տարին լրանալու օրը: Կառավարության 2019 թ.-ի «Քաղաքացուն բացառիկ դեպքերում պարտադիր զինվորական ծառայությունից ազատելու կարգը սահմանելու մասին» N 89-Ն որոշումը սահմանում է այն բացառիկ դեպքերը, երբ տարկետման ժամկետներն ավելացնում են՝ հաշվի առնելով քաղաքացու նշանակալի նվաճումներ ունենալու հանգամանքը: Նախարարությունը նշում է՝ իրավական ակտերի այս իրավակարգավորումների մեջ առաջանում է հակասություն, մի որոշմամբ սահմանված է տարկետում ստանալու նվազագույն և առավելագույն ժամկետ, ինչպես նաև տարկետում ստանալու տարիքային սահմանափակում` մինչև 26 տարեկանը լրանալը, իսկ մյուս որոշմամբ սահմանափակում սահմանված չէ և քաղաքացին, որն, օրինակ՝ մեկ անգամ 2 տարի ժամկետով ստացել է տարկետում և ունի կարգով նախատեսված նվաճումներ, կարող է հայտ ներկայացնել պարտադիր զինվորական ծառայությունից ազատման:

Գործող կարգավորումների համաձայն՝ քաղաքացին 20 տարեկանում կարող է ազատվել զինվորական ծառայությունից, ինչն անհավասար պայմաններ է ստեղծում, օրինակ՝ կրթության բնագավառում նվաճում ունեցող քաղաքացու համեմատ, ով պարտավոր է ըստ հերթականության ավարտել կրթական ծրագրերը (բակալավր 4-5 տարի, մագիստրատուրա 1-2 տարի և ասպիրանտուրա 2-3 տարի, բայց ոչ ավելի, քան մինչև 26 տարին լրանալը), հետո ստանալ գիտական աստիճան, զբաղվել գիտական և գիտատեխնիկական գործունեությամբ, նոր միայն հավակնել զինծառայությունից ազատման իրավունքի: Այսպիսով՝ նախագծով առաջարկվող կարգավորմամբ, քաղաքացին, որն ունի նվաճում և ստացել է 2 տարի ժամկետով տարկետում, պետք է շարունակի իր մասնագիտական գործունեությունը, կատարելագործվի, ունենա նոր նվաճումներ և հավակնի նոր տարկետման իրավունքի, և այդպես` մինչև 26 տարին լրանալը, որից հետո միայն, որպես իրապես բացառիկ դեպք, կարող է հավակնել զինծառայությունից ազատման իրավունքի:

Նախագծի 1-ին կետի 2-րդ ենթակետով առաջարկվող փոփոխության համաձայն` պարտադիր զինծառայությունից կարող են ազատվել զորակոչային տարիքի օտարերկրյա անձինք, ովքեր կստանան ՀՀ քաղաքացիություն և հանդես կգան ՀՀ հավաքական թիմերում: Այս կարգավորման նպատակը սպորտի բնագավառի զարգացումն է: Նշվում է, որ հաճախ հավաքական թիմերում հանդես գալու համար հրավիրվում են իրենց մարզաձևում հաջողություններ արձանագրած և հեռանկար ունեցող հայկական ծագմամբ կամ օտարազգի այլ երկրների քաղաքացիներ, որոնք ստանում են ՀՀ քաղաքացիություն և նրանց վրա տարածվում են ՀՀ քաղաքացիների համար օրենսդրությամբ սահմանված բոլոր իրավունքներն ու պարտավորությունները, այդ թվում նաև պարտադիր զինծառայության զորակոչվելու պարտավորությունը, իսկ դա առաջացնում է հավել յալ դժվարություններ: Մինչդեռ այս կարգավորմամբ ֆեդերացիաները հնարավորություն կունենան հրավիրելու մարզիկներին՝ երաշխավորելով, որ նրանք կազատվեն պարտադիր զինվորական ծառայությունից:
