Սահմանադրական բարեփոխումների կոնցեպցիայի և մասնավորապես, դատական բարեփոխումների մասին Orer.am-ի զրույցը փաստաբան Հասմիկ Օհնիկյանի հետ:
Վերջին օրերին ակտիվ քննարկման առարկա է դարձել երկրում սահմանադրական բարեփոխումների իրականացման անհրաժեշտությունը: Հայեցակարգով առաջարկվող բարեփոխումներն առնչվում են նաև դատական համակարգին: Ինչպե՞ս եք գնահատում դատական համակարգին վերաբերող բարեփոխումները:
Հայեցակարգով դատական համակարգին առնչվող բարեփոխումները, առկա խնդիրների լուծման մեխանիզմները այս պահին հստակ չեն, այնուամենայնիվ դատական համակարգում բարեփոխումներ կատարելու անհրաժեշտությունն անհերքելի է:
Առաջարկվում է մասնավորապես եռաստիճան դատական համակարգից անցում կատարել երկաստիճանի: Ո՞րն է Ձեր կարծիքն այս հարցի վերաբերյալ:
Գործնականում ներկայումս էլ դատական գործերի բացարձակ մեծամասնությունը քննության է առնվում երկու ատյաններում: Դատական համակարգի երրորդ ատյանի՝ Վճռաբեկ դատարանի դերը կայանում է օրենքի միատեսակ կիրառության ապահովման, իրավունքի զարգացմանը նպաստելու մեջ, հետևաբար միայն բացառիկ դեպքերում է գործի քննությունն իրականացվում երեք ատյանների մակարդակով: Այս տեսակետից, կարծում եմ, առաջարկվող փոփոխությունը գործող իրողությունից քիչ է տարբերվելու:
Այդ դեպքում արդյո՞ք դատական ատյանների կրճատումն անհրաժեշտություն չէ դատավարության արագությունն ապահովելու առումով:
Չեմ կարծում, որ դատական ատյանների կրճատումը կարող է այդ առումով ակնհայտ շոշափելի արդյունքներ երաշխավորել, քանի որ մենք խնդիր ունենաք նախ դատարանների կողմից միևնույն ատյանում գործի քննության ողջամիտ ժամկետի պահպանման առումով:
Այս տեսակետից առավել կարևորում եմ դատավորների պատասխանատվության անխուսափելիության ապահովում՝ որպես դատական բարեփոխումների հիմնաքար:
Դատավորների պատասխանատվության միջոցներն ու մեխանիզմները՝ պայմանավորված տվյալ երկրի առանձնահատկություններից, միմյանցից տարբերվում են: Օրինակ Գերմանիայի Դաշնությունում և որոշ այլ երկրներում սահմանադրորեն ամրագրված է դատավորին այսպես կոչված սահմանադրական պատասխանատվության ենթարկելու Սահմանադրական դատարանի իրավունքը, որի հիմքը դատավորի կողմից սահմանադրությամբ ամրագրված սկզբունքների կամ լիազորությունների ոչ պատշաճ իրականացումն է: Սահմանադրական պատասխանատվության միջոցներն իրենց բնույթով և առաջացնող հետևանքներով միանշանակ առավել խիստ են և միգուցե դատավորներին առավել սթափեցնող. յուրաքանչյուր երկիր, ելնելով իր առանձնահատկություններից, պետք է իր համար ընտրի խնդրի արդյունավետ լուծման ընդունելի տարբերակը, որը չի ոտնահարի դատարանների անկախության սկզբունքը և միևնույն ժամանակ չի սահմանափակվի դրանով:
Այժմ արդեն որպես իրավաբան, ի՞նչ կարծիք ունեք հայեցակարգով առաջարկվող մնացյալ արմատական բարեփոխումների վերաբերյալ: Խոսքը, մասնավորապես, վերաբերում է կառավարման համակարգի փոփոխմանը և դրանով պայմանավորված նոր ինստիտուտների ներմուծմանը:
Դրական եմ համարում հանրային պետիցիայի ինստիտուտը գործարկելու հայեցակարգով ներկայացվող առաջարկը: Ուրախությամբ պետք է նշեմ, որ Հայաստանում ունենք կայացող քաղաքացիական հասարակություն, ուստի հանրային պետիցիայի ինստիտուտը, որպես անմիջական ժողովրդավարության գործուն մեխանիզմ, անհրաժեշտություն է:
Ինչ վերաբերում է պառլամենտական կառավարման համակարգին, ապա գտնում եմ, որ այն առավել ժողովրդավարական է, քանի որ իրենից ենթադրում է երկրի այսպես կոչված «կոլեգիալ» կառավարում, առավել կայուն է՝ հանրապետության նախագահի ընտրությունը և գործադիր մարմնի ձևավորումը խորհրդարանի կողմից իրականացվելու և նրա վստահությունն ունենալու շնորհիվ, ինչպես նաև առավել արդյունավետ՝ որոշակիորեն կայուն և միմյանց զսպելու ունակ իշխանություններ ունենալու շնորհիվ:
Այնուամենայնիվ, պետք է նկատի ունենալ, որ ցանկացած արմատական փոփոխություն, նոր ինստիտուտի ներմուծում և գործարկում կարող է առաջ բերել որոշակի բարդություններ, ուստի այս տեսակետից կարևորվում է ժողովրդի միասնականությունն ու հանդուրժողականությունը:
